   JCT: Jeff Harris and the first dozen or so Plaintiffs   
   claimed a 1st Cause of Action over the too-long processing   
   time for their permits.   
      
   After realizing that that time spent processing was knocked   
   off the time for the permit, the next few dozen Plaintiffs   
   updated the Statement to claim a 2nd Cause of Action to get   
   their time back.   
      
   After the Johnsgaard hearing where   
   1) Justice Brown indicated that jeopardy of fines and   
   imprisonment engaged the Right to Liberty.   
   2) Jon Bricker claimed that the guy with the broken arm   
   couldn't claim the Right to Life but the Right to Security   
   of the Person and I only ever claimed the Right to Life.   
      
   So I upgraded the Statement of Claim to now also claim the   
   Rights to Liberty and Security with Life. That's covered.   
      
   And I've added a point the Crown made that we're supposed to   
   argue that no principles of fundamental justice is served by   
   the violation of those rights. In times of war, your Right   
   to Life is gone when you hear "Charge." In emergency, your   
   Right to Security is gone when you hear: "We need commandeer   
   your house." But no principle of fundamental just is served   
   by them delaying your permits, by them having short staff.   
      
   And that's the issue here. This is a violation that could   
   have been avoided with sufficient staff! It's a staffing   
   question.   
      
   So Jeff Harris filed a motion asking the judge to upgrade   
   Statement of Claim of the early Gold Stars to the Soc of the   
   newbies:

    NOTICE OF MOTION TO AMEND AND EXTEND TIME   
      
   TAKE NOTICE THAT on Friday Feb 16 2018, the Applicant will   
   make a motion by teleconference, with leave of the judge or   
   on short notice if necessary, for an Order   
   A) amending the Applicant's Statement of Claim and   
   B) extending the time to file and serve the Plaintiff's   
   Response to the Defendant's Motion to Dismiss the Cause of   
   Action A or Amended Motion to also dismiss the Cause of   
   Action B.   
      
   1. The original claim Applicant seeks to amend was for:   
   1) a declaration that the long processing time for Access to   
   Cannabis for Medical Purposes Regulations ("ACMPR")   
   Production   
   Permits is an unconscionable violation of the patient's S.7   
   Charter Right to Life; and   
   2) damages from such unconstitutional processing delays.   
      
      
   2. The Applicant seeks to substitute the claim from the   
   latest Turmel-Kit Plaintiffs for:   
      
   A) a declaration that the long processing time for Access to   
   Cannabis for Medical Purposes Regulations ("ACMPR")   
   Production Registrations and Renewals violates the patient's   
   S.7 Charter Right to Life, Liberty, Security with no   
   principle of fundamental justice such as war or emergency to   
   necessitate and absolve such violations; and claims remedy   
   in unspecified damages under S.24 of the Charter in the   
   amount of the value of the Applicant's prescription during   
   any delay which this Court may rule inappropriate for a   
   reasonable processing time for Registrations for medication,   
   and   
      
   B) a declaration that back-dating the period of Registration   
   and Renewal from the Effective Date for Registration or   
   Expiry Date for Renewals as under the MMAR to the date the   
   doctor signed under the ACMPR violates the patient's S.7   
   Charter Rights and claims remedy for the full term of the   
   prescription to take effect on the Effective Date of the   
   Registration and on the Expiry Date of a Renewed   
   Registration like the Health Card, Driver's License and   
   MMAR.   
      
   THE GROUNDS FOR THE MOTION ARE that   
      
   A) the Defendant must inevitably respond to the B Cause of   
   Action for "full-term" Registrations for the newest Turmel-   
   Kit Plaintiffs and early Plaintiffs have suffered the same   
   Registration short-changing; amending the Turmel-Kit claims   
   to seek both remedies is better than filing separate new   
   claims.   
      
   B) the Plaintiff's failure to defend on time against   
   Defendant's motion with intent to file on the Defendant's   
   due date of Feb 12 for Reply was based on a misperception of   
   "Defendant." Thought it was those defending the motion. The   
   Defendant has consented to extending the time to Feb 19   
   2018.   
      
   B) Plaintiff is prepared to file the Response on the motion   
   to dismiss Cause of Action A by Feb 19 if so Ordered and a   
   Response on the motion to dismiss Cause of Action B later;   
   but seeks to extend the time to respond to attempted   
   dismissals of both causes of action until after Defendant   
   files any motion to dismiss the B Cause of Action for Full   
   Term.

   2. Later Claims were updated to also claim Cause of Action   
   B:

   3. After the Johnsgaard hearing in January where the Court   
   noted that the Right to Liberty may be engaged, the Crown   
   cited the failure to claim the engagement of S.7 rights   
   other than Life with no principle of fundamental justice   
   served by such violations, the latest Claims do now cite the   
   Right to Liberty and Security of the Person with Life and   
   note no principle of fundamental justice is served by such   
   violation.   
      
   4. Since the Crown must deal with both Cause of Action A & B   
   in the latest claims, it would be most expeditious for   
   previous claims to be amended to adopt such upgrades rather   
   than new claims be made for Cause of Action B.   
      
   5. Defendant has consented to an extension of time to file   
   Plaintiff's response to the motion to dismiss until Feb 19   
   2018.
