|    TURMEL: Heidi Chartrand gets 18-day Hop-    |
|    16 Feb 18 15:20:43    |
From: johnturmel@yahoo.com              JCT: Heidi just showed me the letter from Jon Bricker with       the good news. Told she'd have to wait for normal       procedures on Feb 7, they got it out in 18 days.                     Department of Justice       Toronto              Feb 16 2018              The Honourable Mr. Justice Brown              Dear Justice Brown:              RE: CHARTRAND, Heidi, v. Her Majesty The Queen (Turmel Kit)        COURT FILE NO: T-144-18              On behalf of the defendant, Her Majesty The Queen in Right       of Canada, I am writing to provide an update concerning the       plaintiff's outstanding motion for interlocutory relief.              By Responding Motion Record dated Feb 8 2018, Canada       requested that the plaintiff's motion be dismissed, with       costs, on the ground that the plaintiff had not met the test       for either an interlocutory injunction or an order in the       nature of mandamus.              I am advised by Health Canada that, subsequent to the filing       of Canada's responding motion record, Health Canada       completed its review of the plaintiff's application for       registration to produce cannabis for her personal medical       use, and granted the application confirming her registration       has been sent to the plaintiff via Express Post.              Yours truly,       Jon Bricker              JCT: They could have avoided this embarrassing hop-to-it if       they'd acted right after she had first filed a motion and       Judge Brown had given them more time. A week later, nothing,       she brought another motion. Again, they had a chance to hop-       to-it and avoid Heidi responding with yesterday's killer       shots. And now, a day later, we get the letter saying that       they'd gotten it done sometime earlier, not sure what date.       Heidi will know when she gets it and sees Effective Date.              Still, according to their records, they say they received it       Jan 26 2018 and got it out before Feb 16 2018. That would be       21 days, beating Waylon O'Reilly's 22 day renewal. And if       Effective date, is a few days earlier, knock off a few more.       Still, wasn't fast enough to avoid the Crown now being stuck       having to argue a motion is mooted again.              Since they have now complied for interim relief in       processing her permit, I think he's going to dismiss it as       mooted. I just don't see him awarding them costs from her       for them caving in under 3 weeks.              Tell me the squeaky wheel doesn't get the oil?              --- SoupGate-Win32 v1.05        * Origin: you cannot sedate... all the things you hate (1:229/2)    |
