   TURMEL: Donald Cote asks Court for MedPot Permit after 8 months wait   
      
   JCT: Luc signed on another 4 people on Monday. Including   
   Donald Cote who has filed a Statement of Claim and Motion   
   for Interim Remedy. It's a record stall! 8 months!   
      
      
                         NOTICE OF MOTION   
   TAKE NOTICE THAT on Monday March 5 2018, at 9:30am, the   
   Applicant will make a motion by teleconference to the Court,   
   with leave of the judge necessary.   
      
   THE MOTION IS FOR an Order granting Applicant interim relief   
   1) a personal constitutional exemption to start growing   
   marijuana pursuant to the conditions in the application   
   until the Health Canada delivers the needed Registration,   
   or, in the alternative,   
   2) an Order of Mandamus that Health Canada immediately do   
   its duty by processing the requisite Registration.   
      
   THE GROUNDS FOR THE MOTION ARE that under the Harper MMAR,   
   the time to process an application to produce marijuana was   
   touted before this Court by Dr. Stephane Lessard, Controlled   
   Substances and Tobacco Directorate, as done in under 4   
   weeks, and renewals, far less." Under the ACMPR, with only   
   production Registrations to deal with, that time has been   
   raised to almost 34 weeks for mine.

                      APPLICANT'S AFFIDAVIT   
      
   I, Donald Cote make oath and say as follows:   
      
   1. On Jun 12 2017, my doctor signed my application under the   
   ACMPR for my Designated Person to produce marijuana to treat   
   my liver and colon cancers with my oxygen tanks keeping me   
   housebound.   
      
   2. On Jun 29, 2017 a completed application was submitted to   
   Health Canada.   
      
   3. After 8 months, 34 weeks, I have not yet received it and   
   do not know how many Applications are ahead of mine nor how   
   long it will take to process them first.

               APPLICANT'S WRITTEN REPRESENTATIONS   
      
   1. In the case of Raymond Turmel T-977-13, the time to   
   process an application to produce marijuana under the MMAR   
   was touted by Dr. Stephane Lessard, Health Canada Controlled   
   Substances and Tobacco Directorate, as vdone in under 4   
   weeks, and renewals, far less.   
      
   2. Given Applicant has waited not 4 but over 34 weeks,   
   Applicant's claim seeks a declaration that the long   
   processing time for processing of Access to Cannabis for   
   Medical Purposes Regulations (>ACMPR>) Production   
   Registrations is an unconstitutional violation of the S.7   
   Charter Right to Life, Liberty and Security.

   JCT: So, it looks like Health Canada are still jerking   
   people around for 8 months? This is a record, the previous   
   was only 30 weeks. This looks like it's going to take 35   
   weeks.   
      
   The Registry dropped the March 5 date and said the judge   
   would set the date.   
      
   So now Health Canada has to hop to it or explain what's   
   taking them 2/3 of his prescription to process? And there's   
   no abandonment, we're going to find out why 8 months?   
      
   I'm still stunned they have these kind still outstanding.   
   With our Delayeds kits out there, you'd think they'd have   
   really gotten a move on but I guess the extra 30 staff   
   hasn't made much of a dent in the pile.
