From: johnturmel@yahoo.com              TURMEL: Mathiew Chayer-Poulin gets Hop-To-It Pot Grow Permit              JCT: Okay, here's another hop-to-it to mooten a motion       for interim relief. Jon Bricker writes:              Re: CHAYER-POULIN, Mathiew v. HMTQ File No T-363-18              I confirm receipt of your motion record dated March 1 2018.              JCT: Justice Brown ordered to respond to it by March 12.              JB: I am advised by Health Canada that it has now approved       your application for registration to produce cannabis for       your personal medical use, and that your registration is       currently valid. I am also advised that a certificate       confirming this registration has been sent to you via       registered mail.              Your motion for interim relief is therefore now moot. In       light of this, I ask that you abandon your motion by       completing the enclosed Notice of Abandonment. If you wish       to discontinue your underlying claim, please also complete       the enclosed Notice of Discontinuance. Once completed,       please serve and file these or provide me with electronic       copies for filing on your behalf.              I ask that you file or return the Notice of Abandonment by       10am on Monday March 12. Should you decline to abandon your       motion, please be advised that my client will oppose the       motion and reserves the right to seek its costs of the       motion.       Jon Bricker              JCT: Mathieu will abandon after their response explaining       why it took so long. Or not.              Notice how they include a Notice of Discontinuance which       aborts the whole action, not just the motion for interim       relief. One lady ended up sending in both letters and her       action is now discontinued. No damages for her.              So warning, do not file to "discontinue" your action, file       to "abandon" your motion.              --- SoupGate-Win32 v1.05        * Origin: you cannot sedate... all the things you hate (1:229/2)    |
