      From: johnturmel@gmail.com              JCT: The Crown has argued that our Plaintiffs' Cause of       Action B, permit too short, was mooted by the S.56 orders       that make it so no one registering after March 2 2018 will       be short-changed. Except, we now have a case of a guy who is       proof-positive that his registration before March 2 has not       been extended to moot the claim. Before we reply to the       Crown's argument that his problem has been solved. Har har       har har har har. Like catching a card in the guts for the       nut straight.              T-849-18        FEDERAL COURT       BETWEEN:        Kent Wilfred Truman        Applicant        and        Attorney General of Canada        Respondent              TAKE NOTICE THAT on May 8 2018, the Applicant will make a       short notice motion by telephone with leave of the court if       necessary.              THE MOTION IS FOR an Order granting Applicant interim relief       in:              A) documentation that the Mar 2 2018 S.56 Class Exemption       has mooted my need to have my Registration extended until       Sep 5 2018              B1) a personal constitutional exemption to continue growing       marijuana pursuant to the conditions in the ACMPR       Registration MCR-44452 until the Health Canada delivers the       needed renewal, or, in the alternative,              B2) an extension of Applicant's expiring Exemption; or,              B3) an Order of Mandamus that Health Canada immediately do       its duty to process the renewal before the permit expires.              JCT: It was lovely to be able to put the Crown on the spot       to produce S.56 Order that moots his short-changed permit. I       know it's not there and that what is there only helps       newbies but Wendy said it mooted the need of the oldies and       now she has to prove it before we have to respond.              And since his permit expires tomorrow, I'd expect Judge       Brown to do the same as in the past and give Wendy until       noon to respond for an afternoon hearing tomorrow.               APPLICANT'S AFFIDAVIT              I, Kent Wilfred Truman, residing in York, Ontario make oath       and say as follows:              1. On Sep 5 2017, Health Canada issued Registration MCR-       44452 to produce my cannabis which expires on May 5 2018.              JCT: Oops, it expires on May 8 2018, typo.              2. After reading about a S.56 Class Exemption to mooten the       claims of Plaintiffs seeking their full-term, I called       Health Canada and was told my Registration was extended by       the 4 months I had lost to Sep 5 2018. I did not receive an       updated certificate of registration.              3. On April 9 2018, 5 months in advance of my undocumented       Sep 5 expiry date and 1 month before expiry of my May 8       registration certificate, I submitted my renewal. I have not       yet received my renewed registration.              4. On May 5, I learned that despite the Health Canada having       told the Court that the problem of short-changed plaintiffs       had been mooted by a S.56 Class Exemption that would no       longer short anyone after March 2, actually, the S.56 Class       Exemption for those registering after March 2 had not       extended the exemptions of anyone registered before Mar 2.              5. On May 8 2018, my registration expires and my Designated       Person must destroy my plantation and stored cannabis.              JCT: Glad the typo gets corrected here.               WRITTEN REPRESENTATIONS              1. Applicant is an ACMPR exemptee to use marijuana for       medical purposes number MCR-44452 with expiry on May 8 2018       who submitted a renewal on April 9 2018 and has not yet       received it.              2. The Health Canada Renewal instruction page states:        It is recommended to submit your renewal application at        least 6-8 weeks before the expiry of your current        registration certificate.              3. At a hearing before this Court in Raymond Turmel v. HMQ       T-977-13, Justice Roy was informed that Dr. Stephane       Lessard, Controlled Substances and Tobacco Directorate had       said: "Most Exemptions are done in under 4 weeks, and       renewals, far less.'              4. Under the ACMPR, with only production Registrations to       deal with, that time has been raised up to 11 months for       applications and 16 for renewals. And though the Renewal       Information Page suggests submitting renewals 6-8 weeks       before expiry, it does not mention it will be renewed 6-8       weeks after expiry due to short staff swamped by many       applications. Lead Plaintiff Jeff Harris T-1379-17 was       renewed under the MMAR in 2 weeks. What's to check?              5. The only reason this application is on short notice is       that Applicant was informed by Health Canada that his permit       had been extended by the S.56 Class Exemption used to mooten       the claims of other Plaintiffs seeking the full-term of       their prescriptions. He has not received an updated       certificate.              6. With 5 months before supposed expiry, but only 1 month       before actual expiry, Applicant submitted his renewal in       seeming plenty of time.              7. It would seem that the S.56 exemption does not extend his       permit to mooten the claims of plaintiffs for full terms.       Applicant faces devastating consequences by the failure of       the S.56 Class Exemption to mooten his predicament.              JCT: Serendipity to have this expiring permit land in my       hand just after the Crown misled the court into thinking       that the S.56 Class Exemptions settled the claims of       our Plaintiffs. Har har har har har har.              Stay tuned. I doubt Justice Brown will let it expire without       Wendy explaining how they've solved his problem.
