      From: johnturmel@gmail.com              JCT: Donald Cote's Motion Record was filed in Montreal today       asking the case management judge for the usual telephonic       hearing. This is the most incredible story about how Health       Canada gets to reject almost two/thirds of all applications,       how they rejected 92% in November 2017! You know 92% of the       applicants didn't screw up their name, birthdate, address so       how could so many be rejected? Here's the Affidavit of his       Facts!              File No: T-377-18        FEDERAL COURT       BETWEEN:        DONALD COTE        Applicant        and        HER MAJESTY THE QUEEN        Respondent              1. On June 29, 2017, Application #1 of Donald Cote was       submitted.              2. On July 21 2017 Health Canada rejected the original       signature on the medical document as not original.       (Defendant's Written Representations in Response.)              JCT: Got that, it's in the Crown's own response.              3. On Sep 5 2017, Application #2 with another original       medical document was submitted.              4. On Dec 8 2017, after four months without Health Canada       having processed the Sep 5 Application #2, Plaintiff's site       was busted and Application #3 to amend the site address was       submitted.              5. Ex. A of the Affidavit of Benoit Seguin dated March 9       2018 with the Jan 3 2018 Health Canada rejection of the Dec       8 Amended Site Application for non original signatures, the       second time.              JCT: So Ex.A of the Crown's Record shows that his       application was rejected for non-original signatures a       second time.              JCT: His second Application and again same reason to say no.              6. On Feb 20, Health Canada agent #A242 suggests filing the       application in blue ink would be more original.              7. On Feb 26, a Statement of Claim T-377-18 that the process       is taking too long is filed.              8. On Feb 27, a Motion for interim remedy is filed.              9. On Mar 5, Application #4 is submitted in blue ink.              10. On March 12, Defendant informs the Court that the       medical practitioner was a chiropractor not qualified to       sign.              JCT: So that nixed Application #3 for wrong doctor.              11. Ex. 1 is the March 13 Health Canada rejection of the       blue ink Application #4 as not original signatures, third       time.              JCT: So the Rejection letter indicating non-original       signatures was his first exhibit. Added to the two       rejections in the Crown's Response, that's 3 times! Even       though it had been the wrong doctor, it was still another       rejected for non-original signature.              12. On Mar 27, with a new medical document from a qualified       medical practitioner dated Mar 19, Application #5 was       submitted.              13. On Apr 5, 9 days later, a second Statement of Claim T-       684-18 was filed.              14. On Apr 20, 2 weeks later, a Motion for interim relief       was filed.              15. On Apr 23, Brown J. gave the Canada until May 2 to       respond.              16. Ex. 2 is the Apr 24 rejection of Application #5 because       of not original signatures, fourth time.              JCT: Imagine, 10 months trying and 3 previous rejections for       non-original signatures and they rejected him again for the       same reason. His second exhibit is his fourth such rejection!              18. On May 1, despite having returned Donald Cote's       application as incomplete, the Crown alerts the Court that       Health Canada has issued Donald Cote's Certificate MCR-61467       which mootens the May 2 hearing.              19. Ex. 3 is a picture of Donald Cote dated June 6 2018 with       his ACMPR Registration Certificate MCR-61467 and his       application for it that was rejected and returned as       incomplete.               APPLICANT'S WRITTEN REPRESENTATIONS              1. After having had applications for a Registration       Certificate to produce marijuana with original signatures       rejected four (4) times as non-original signatures,       Defendant Health Canada nevertheless granted the Applicant a       Registration Certificate MCR-61467 without possessing the       application form.              2. In case the Registration Certificate is not valid       without a completed application, Applicant seeks an Order       granting:              1) a personal constitutional exemption to continue growing       marijuana pursuant to the conditions in the ACMPR       Registration Certificate MCR-61467 until the Health Canada       delivers the needed Registration, or, in the alternative,              2) an extension of Applicant's Registration Certificate       MCR-61467 until the submitted original medical document is       processed as valid;              3) an Order of Mandamus that Health Canada do its duty to       process the application for the Registration Certificate       MCR-61467 based on the original medical document submitted       as valid as soon as it is returned to Health Canada.              JCT: Wild story, right. Remember, who's going to prove their       weren't right about the signatures, except Art Jackes who       has his original to show the court in his case, and now       Donald and Nicole.              Remember, last week, Nicole Van Edig filed exactly the same       kind of motion. After stalls and delays, like Donald, she       had filed a motion for hearing on her day of expiry! They       delivered it to her two days before so Wendy could argue the       hearing had been mooted. But they didn't have her       application, they'd sent it back. So why would they issue       her permit when they didn't have her application, only a       motion hanging over their heads?              Same now with Donald. They delivered his permit 2 days       before his hearing to mooten it and they too did not have       his application completed in their possession. They'd sent       it back. So why would they issue his permit when they didn't       have his application, only a motion hanging over their       heads?              So who thinks Judge Brown is going to have as tough time       accepting that rejections of originals as "non-original" is       the only probable reason for the incredibly high number of       rejections? Unless he thinks people are stupid enough to not       send originals despite it saying to do so, or stupid enough       to now know their name, birthdate and address correctly?              So after making the case in our Response which the Crown has       asked the Court not to consider, we get to show him a most       egregious example of that abuse, not just probably abuse. If       they can have gotten it wrong for one guy 4 times, think       they may have gotten it wrong for others too?              So, nice to have this one on Judge Brown's desk showing a       quadruple abuse of which others have already complained that       explains high rejection stats and the second time they issue       a permit without a completed application in hand to duck a       court hearing.              --- SoupGate-Win32 v1.05        * Origin: you cannot sedate... all the things you hate (1:229/2)    |
