|    TURMEL: David Oldham asks Court how long    |
|    05 Jul 18 15:25:59    |
From: johnturmel@gmail.com              JCT: David Oldham contacted me a while back about his       permit. He'd lost his MMAR Manson permit by having had to       move and was in a rush to get back into operation for his       cheap bud.              I told him to give them the MMAR 4 weeks standard wait       before hitting them. So he gave them the 4 weeks.              On June 28, he filed both a Statement of Claim and a Motion       for Interim Remedy.              On June 29, Judge Brown refused to life the stay allowing it       to be heard which he had imposed on all the actions "given       the short time."              This happened a while back when Gustav Beland had made a       motion after just over weeks and Judge Brown ruled that       there had not been enough time for them to process it.              I prepared a letter for Gustav to ask the judge how long to       wait was too long but his helper delayed sending it and then       it was mooted by the arrival of his permit.              Same move as for Jeff Harris, permit sent right after the       judgment. Except, in that one, there had been a delay and we       lost the chance. But now we have the chance again.              David just emailled off the following letter to the Court       asking for a Direction! Wonder if his permit arrives soon       like Gustav's and Jeff's did?               Thursday July 5 2018        VIA EMAIL               Colinne Martin, Colinne.Martin@cas-satj.gc.ca and        Federal Court Registry Officer,        Wendy.Wright@justice.gc.ca        Counsel for the Defendant               Re: OLDHAM, David George v. HMTQ (Turmel Kit) T-1256-18               Please place this emailled letter before His Honour Mr.        Justice Brown asking that the metadata be proof of        service on the Defendant.               Despite processing time being touted as done in under 4        weeks under the MMAR, my motion for interim remedy after        4 weeks was dismissed "given the short time."               In the Johnsgaard case T-134-18, this court mentioned a        6-8 week delay may be a tolerable deterioration of        service. If waiting only 4 weeks is too short, is        waiting 8 weeks or even 6 weeks long enough? After how        long should Applicant return before this court for        remedy?               Having noted permit delays from 5 to 7 to as long as 11        months, I have no idea how long is long enough before        asking again.               I would ask the Court for a Direction that the Defendant        Health Canada supply the following data:               1) What is the current turn-around time to register a        completed application?               2) How many applications now precede mine in the queue?               3) How long will I wait while others are processed        first?               Without such information, I, nor the Court, can know        when how long I wait is no longer a too short time?        David George Oldham              JCT: So now, the Court is put on the spot to tell us how       long it too long because we don't know and we do know       they've taken up to 11 months. And it would be sweet if we       got it in right under the wire like Jeff did.              --- SoupGate-Win32 v1.05        * Origin: you cannot sedate... all the things you hate (1:229/2)    |
