JCT: Last week, Steve Vetricek had trouble filing his motion
for interim relief in Federal Court. He got a letter from
Colinne Martin, the Registry Officer in charge of the ACMPR
plaintiffs before Case Management Judge Brown.

   Hi Mr. Vetricek,
You can print a copy of your sent email to Ms. Wright where
it shows it was sent to her, and upload that along with your
motion record via our e-filing service. The Registry is
accepting no documents via email, regardless of whether
they're for Justice Brown or not. Please also send by e-
filing a letter indicating that you are requesting that the
Court accept the metadata as proof of service on the
Defendant. When we get your motion and your request for
directions by e-filing, they will be sent to Justice Brown
   for directions. Colinne Martin
   ---

   REQUIREMENTS:
   1) copy of your sent email to Ms. Wright
   2) motion record via our e-filing service.
   3) a letter indicating that you are requesting that the
Court accept the metadata as proof of service on the
   Defendant.

So with those instructions, he e-filed his Motion Record,
the email metadata for acknowledgment of receipt and a
letter asking the judge for Directions.

JCT: As of now, no response from Judge Brown on his motion
for a hearing for his motion after 9 months.

Jeff Harris has written a letter to the Court asking for a
Direction that the Crown respond to the damages claim for
site rent and expenses in their Statement of Defence. He too
got a rejection after sending his 1) letter for Statement of
Defence Direction, 2) metadata and 3) letter for
metadata Direction! So he wrote to Colinne.

   Hi Colinne,
I hope you are doing well.
I hope you can help me here.

Since you are no longer dealing with the ACMPR stuff i have
been trying to submit stuff through the website. That has
become a problem with the clerks not wanting to pass the
letters on to the Judge for a direction and not accepting
the metadata as proof of service. Judge Brown has allowed me
to send things by email for this so i am wondering, who
would i send these to now? Or, is there some wording you
know of so the clerks will pass the letters on as requested?
   Thank you Jeff Harris

   Hi Jeff,

What you should be doing is submitting via e-filing the
motion record for filing, along with a letter addressed to
Mr. Justice Brown, Case Management Judge in these matters,
attaching a copy of your sent email that shows that it was
sent to the Defendant by email, the date, time etc.

In your letter you should request the Court's direction that
the attached metadata be accepted as proof of service upon
   the Defendant.

The Registry should not be refusing it for filing, but
should be sending it to Justice Brown for directions.

JCT: OK, that's what both Steve and Jeff have done.

I will pass this message along to the Senior Registry
Officers in Ottawa to be shared with the staff here in
Ottawa as well as their colleagues in the regional offices.
   Colinne Martin

JCT: That would be nice that those replacing her know the
special privileges Judge Brown has already granted us in
   effecting online service.

   So the http://johnturmel.com/delscins.pdf now has
instructions to include the 3 pdfs to upload a motion. Just
waiting for responses to Steve and Jeff's filings now.
