TURMEL: Crown wants stay to ponder appealing!!

JCT: No kidding. My last post: "Crown wants to stall
   Delay Actions for appeals" at
   https://groups.google.com/forum/#!topic/alt.fan.john-turmel/T529idNp_Zk

She said the Crown was considering whether to file a cross-
appeal and wanted a Direction staying the main claims in
   case they do.

I hadn't really focused on the funny premature nature of the
request but now have. A great chance to cut away her branch
   of the tree:

   File No.: T-1379-17

   Dear Registrar:

   1. In an Aug 22 2018 letter, Defendant Canada writes:
On August 20, 2018, the Plaintiff filed a Notice of
Appeal of this Court's July 20, 2018, Order striking
paragraphs l(b), 8 and 9 of the Amended Statement of
Claim. As a result of the appeal, the Defendant Her
Majesty the Queen in Right of Canada ("Canada") is
considering whether to cross-appeal of the portion of
the July 20, 2018, Order which dismissed the balance of
    Canada's motion to strike.

   2. The Defendant is in default of filing a Statement of
Defence on the A claim not struck from the Amended Statement
of Claim against which they are considering a counter-
   claim.

   3. The Defendant then points out all the advantages that
would accrue if they should cross-appeal and asks for a
Direction that the proceedings below be stayed in case they
do cross-appeal. Can a Defendant in default be asking the
Court for a anything at all?

   5. The Defendant has until Aug 30 2018 to decide on whether
   to cross-appeal.

   6. I will reply once I know whether...

JCT: Har har har. It's your turn, not mine. I'm not showing
you my cards until you show me yours.

Wonder if Judge Brown will stay the actions below before
finding out if the Defendant cross-appeals? Bet not.
