Cory       Cockerell said he had originally printed his name in the       signature box of his application, covered it with white-out,       and signed anew and it was rejected as an improper       signature!! He sent in a good signature and nothing happened       in almost 2 months. So:               File No: T-1094-19        FEDERAL COURT              Between:        Cory Cockerell        Plaintiff        AND        Her Majesty The Queen        Defendant        STATEMENT OF CLAIM        (Pursuant to S.48 of the Federal Court Act)              1. The Plaintiff seeks              A) a declaration that the long processing time for       Production Registrations under the Cannabis Act &       Regulations violates the patient's S.7 Charter Right to       Life, Liberty, Security not in accordance with principles of       fundamental justice to not be arbitrary, grossly       disproportional, conscience-shocking, incompetent,       malevolent; and claims remedy in unspecified damages under       S.24 of the Charter in the amount of the value of the       Applicant's prescription and lost site rent and expenses       during any delay which this Court may rule inappropriate for       a reasonable processing time for Registrations for       medication.              THE PARTIES              2. The Plaintiff Possesses a Medical Document to use       cannabis for medical purposes under the Cannabis Act &       Regulations.              3. The Defendant, Her Majesty the Queen in Right of Canada,       as represented by the Attorney General of Canada, is named       as the representative of the Federal Government of Canada       and the Minister of Health for Canada who is the Minister       responsible for Health Canada and certain aspects of the       Controlled Drugs and Substances Act including the Cannabis       Act & Regulations.              FACTS              4. On April 16 2019, Plaintiff submitted an Application for       a Registration to grow cannabis for medical purposes. The       application was returned for a new signature as applicant       erroneously printed his name in the box and then covered it       with white-out before signing.              5. On May 16 2019, Plaintiff submitted a new page with a       clear signature. In almost 2 months, I have received no       response.              6. Under the MMAR, the time to process an application to       produce marijuana was touted before this Court by Dr.       Stephane Lessard, Controlled Substances and Tobacco       Directorate, as "done in under 4 weeks. Renewals far less."       Reported 2 weeks!              7. With only production Registrations to deal with, the       Cannabis Act & Regulations has no reason to take much longer       to process only these 10 data fields:       Name; Date of birth;       Daily quantity;       Possession limit;       Name of Health Care Practitioner;       Production area (outdoor);       Production site address;       Maximum number of plants outdoor;       Maximum storage Quantity;       Storage Address.              The Plaintiff proposes this action be tried in the       City of Ottawa, Province of Ontario.              Dated at Ottawa on July 8 2019       __________________________________       Plaintiff Signature       Cory Cockerell               NOTICE OF MOTION              TAKE NOTICE THAT on a date and time set by the Case       Management Judge Brown, the Applicant will make a motion by       teleconference to the Court, with leave of the judge to lift       any stay or on short notice if necessary.              THE MOTION IS FOR an Order granting Applicant interim relief              1) a personal constitutional exemption to start growing       marijuana pursuant to the conditions in the application       until the Health Canada processes the needed Registration,       or, in the alternative,       2) an Order of Mandamus that Health Canada immediately do       its duty by processing the requisite Registration.              THE GROUNDS FOR THE MOTION ARE that under the Harper MMAR,       the time to process an application to produce marijuana was       touted before this Court by Dr. Stephane Lessard, Controlled       Substances and Tobacco Directorate, as "done in under 4       weeks, and renewals, far less." Under the Cannabis Act &       Regulations, with only production Registrations to deal       with, there is no reason to take much longer. Plaintiff's       predicament is more acute because his permit is to grow       outdoors and the planting season is almost over and he will       lose his whole year's worth of production.               APPLICANT'S WRITTEN REPRESENTATIONS              1. In the case of Raymond Turmel T-977-13, the time to       process an application to produce marijuana under the MMAR       was touted by Dr. Stephane Lessard, Health Canada Controlled       Substances and Tobacco Directorate, as "done in under 4       weeks, and renewals, far less."              2. Given Applicant has waited 4 weeks to find out about an       objection, and almost 2 more months after submitting a       corrected ap placation, Applicant's claim seeks a       declaration that the long processing time for processing of       Cannabis Act & Regulations Production Registrations is an       unconstitutional violation of the S.7 Charter Right to Life,       Liberty and Security.              3. Applicant's Motion seeks interim relief:              1) a personal constitutional exemption to start growing       marijuana pursuant to the conditions in the application       until the Health Canada processes the needed Registration,       or, in the alternative,       2) an Order of Mandamus that Health Canada immediately do       its duty by processing the requisite Registration.       Dated at Ottawa on July 8 2019       For the Applicant:       Cory Cockerell              JCT: So first they rejected his application because his       signature was on top of white-out. Can't wait to hear them       explain why there was something wrong with that.              And now, almost two months after submitting a new signature,       nothing?
