   TURMEL: Wendy gets Vince Reimer permit issued day after motion filed   
      
   JCT: I told you about about Vince Reimer who applied for an   
   outdoor/indoor permit in May. He got no answer in 5 weeks and filed a   
   Statement of Claim and a motion for interim permit.   
       Notice of Motion contained within a Motion Record on behalf of   
       Plaintiff in writing to be placed before the Court in Ottawa for   
       an Order lifting any stay and granting the Plaintiff interim   
       relief for a personal constituional exemption to continue growing   
       marijuana pursuant to the amended conditions for the Health Canada   
       permit filed on 21-AUG-2019   
      
   Judge Brown dismissed it as premature. In previous motions, he said he   
   wanted to give Health Canada 2 months before we complained. But he did   
   end with a warning to the Crown:   
       2019-07-05 Ottawa    Order dated 05-JUL-2019 rendered by The   
       Honourable Mr. Justice Brown Matter considered without personal   
       appearance The Court's decision is with regard to Motion in   
       writing Doc. No. 3 Result: "THIS COURT ORDERS that the Plaintiff's   
       motion is dismissed without prejudice to the plaintiff bringing   
       further motion if the delay is unreasonable.   
      
   JCT: Judge Brown wrote: "without prejudice to the plaintiff bringing   
   further motion if the delay is unreasonable" and they let the delay   
   get unreasonable with another 7 weeks with no result.   
      
   So on Aug 19, he filed again. On Aug 21, Judge Brown issued the   
   direction:   
       "Motion material accepted for filing. Defendant to file responding   
       material by August 28, 2019 and the Plaintiff to file any reply   
       material by September 4, 2019." placed on file on 21-AUG-2019   
       Confirmed in writing to the party(ies)   
      
   JCT: Then Vince wrote me:   
       VR: Hi John   
       After reading Wendy Wright's email it say that they approved my   
       registration the day after I filed my motion. Kind of funny how   
       that happens after I waited all of this time. Now is there a way   
       that I get my time lost for processing back. My permit is still   
       only good until March 19 next year. They wasted time and fucked   
       around and now I lost three months of a growing season!   
      
   JCT: Your permit will be good for a full year but you are still   
   claiming for the damages caused by the extra 2 month delay. Wendy

   I am advised by Health Canada that it has approved your application   
   for registration to have a designated producer produce cannabis for   
   your personal medical use, and that this registration is currently   
   valid. I am also advised that a certificate confirming this   
   registration has been sent to you on August 20, 2019 via Xpresspost   
   (Xpresspost Tracking: MW 486 805 437 CA) and that the Notification for   
   your designated Producer was also sent to your producer on August 20,   
   2019.   
      
   JCT: Get that, they say the certificate was issued Aug 20. He filed   
   motion Aug 21! If only they were a couple of days faster.   
      
   WW: I have enclosed copies of both for your records.  Your motion for   
   interim relief is therefore now moot. In light of this, I ask that you   
   abandon your motion by completing the enclosed Notice of Abandonment   
   and serving and filing it.   
      
   I ask that you serve us with the Notice of Abandonment by Monday,   
   August 26 at 5 p.m,

   JCT: As if Vince is going to drive to Winnipeg to file and serve the   
   abandonment. She should have accepted a fax and offered to file it for   
   him like she's done for others in the past.   
      
   No, I advise plaintiffs to never sign. I want Health Canada MedPot   
   Director Michael McGuire to explain the reason for the delay in a   
   response which Judge Brown must demand. I'd like to know why it took   
   another 7 weeks after his first motion was nixed as premature and   
   prodded by another motion, to process the permit.   
      
   But Vince is a happy camper. You have to admit it looks like Wendy now   
   knows how to light a fire under Health Canada's asses. Getting it   
   issued the next day must be an indication they had absolutely no good   
   excuse and now they have to explain their no good excuse to the judge.   
      
   Har har har har har har. Imagine, letting a Turmel-Kit plaintiff get   
   to 3 months with no processing when he'd originally complained after 5   
   weeks! A real "duh" move and now they're stuck paying for it.   
      
   It's nice to be able to show the judge that the delays in processing   
   are still ongoing after 2 years.
