HMTQ        Court File No.: T-1141-19              I am counsel for the defendant, HMTQ, in this matter.              I am advised by Health Canada that it has approved your       application for registration to produce cannabis for your       personal medical use and that the registration is currently       valid. I am also advised that a certificate confirming this       registration has been sent to you on September 5 2019 via       Xpresspost.              JCT: Two days after filing on Sep 3!              CR: I enclose a copy of the registration certificate for your       records. As your registration has been granted, your motion       for interim relief is now moot. In light of this, I ask that       you abandon your motion by completing the enclosed Notice of       Abandonment and serving and filing it.              JCT: They should offer to file it if he faxes it to them.              CR: I ask that you serve us with the Notice of Abandonment       by September 10 2019 at 5pm. So I advised him:              John: Don't abandon a motion if you got it filed. They have       to explain the delay. Then you get to Reply before the judge       dismisses it as settled.              https://groups.google.com/forum/#!forum/alt.fan.john-turmel       Check out Vince Reimer who got it issued the day after his       motion. He made them explain the filed a Reply understanding       it's over but wanting to judge to hear the details.              RL: I filed the motion. also that's what the crowm emailed       me about saying that it's now moot and basically threatening       me with paying health Canada's cost if I don't abandon.              JCT: No one's ever been hit with costs on a motion where       they cave yet. It's quite the almost-record hop-to-it. Vince       Reimer got his permit issued the day after he filed his       motion. Two days is another great win.              But they still have to explain the delay. And notice how       quickly the application can get processed once the motion is       filed. Almost always before they have to respond.              It was one great Hop-To-It!              GHISLAIN BEAUFORT              I just noticed another claim with a Motion filed and the       Judge ordering a response.              T-1407-19 Ghislain Beaufort filed his motion on Aug 26 in       Montreal, Judge Brown ordered the Crown to respond by Sep 13       and he can reply on Sep 24.              So once again, Health Canada has to explain more continued       delays even if it caves again.              --- SoupGate-Win32 v1.05        * Origin: you cannot sedate... all the things you hate (1:229/2)    |
