HMTQ T-1371-18              Dear Sir/Madam:              I am writing in response to the Defendant's Oct. 3 2019       letter requesting a Direction on the disposition of my case       after the decision on the Federal Court of Appeal on the       appeal of the Lead Plaintiff. Please place this letter       before the case-management judge, his Honour Justice Brown.              The Court may remember my situation where I was informed       after 9 months and only after I had filed a Statement of       Claim and motion for interim relief that I had left a       required data field blank on my application form. My amended       form was then processed in 3 weeks and my motion mooted by       delivery of the remedy sought. Health Canada's Director       Michael McGuire's Affidavit only mentioned the 3 weeks it       took to process the application once perfected and omitted       the 9 month delay in informing me of the deficiency.              Either it took 9 months to open my mail or my application       was processed expeditiously and then sat on someone's desk       until prodded by the court action.              PREMATURE: HARRIS APPEALS NOT EXHAUSTED              The Defendant cites the recent decision of the Federal Court       of Appeal dismissing the Lead Plaintiff Harris appeal and       seeks a direction that patient plaintiffs serve and file       paper documentation to argue why their actions should not be       similarly dismissed.              The Lead Plaintiff's appeals are not exhausted. He has 60       days to file an Application for Leave to Appeal to the       Supreme Court of Canada, Respondent has 30 days to file a       response, and Applicant has 10 days to file a Reply and then       it takes a few more months for a decision. So asking for a       Direction from below based on a higher decision that is       still being appealed to the top seems premature.              ELECTRONIC DOCUMENTATION TAKES LESS SPACE THAN PAPER              Canada now objects to electronic service by plaintiffs:        Although Canada has not objected to electronic service        of motions by several of the individual plaintiffs in        these matters, Canada's email servers are subject to        strict data size limits which would be quickly exceeded        if all 286 plaintiffs in these matters were to serve        written representations electronically.              That they have enough space in their filing cabinets to       store paper documentation but "Canada's email servers are       subject to strict data size limits which would be quickly       exceeded if all 286 plaintiffs in these matters were to       serve written representations electronically" is erroneous.       Their servers could not be exhausted by 286 files. If so,       they should open a free Gmail or Yahoo account.              Since electronic service of 286 files cannot exhaust the       storage on their servers, then the real reason must simply       be to put bureaucratic obstacles in the way of the patients       who want to file a response.              I would ask that this Court await the result of the final       disposition of the Lead Plaintiff's Application for Leave to       Appeal to the Supreme Court of Canada before making any       Direction requiring my responses to the Defendant's request.       ______________________________       Steve Vetricek       Cc: Wendy Wright Fax: 416-973-0809              Yesterday Jeff received:              Ottawa, Ontario K1A 0H9       October 15, 2019       BY ELECTRONIC MAIL              Mr. Allan J. HER MAJESTY THE QUEEN       Court File No. T-1379-17              This will confirm Direction of Justice Brown dated October       15, 2019.        "The Court has the Defendant's letter of October 3,        2019. This request for relief will be proceeded until        the time for the Plaintiff to seek leave to appeal to        the Supreme Court of Canada, or advise he will not seek        leave, has expired which appears to be November 18,        2019.
