|    TURMEL: Raphael Oswald Jr. LaTortue got     |
|    16 Oct 19 17:48:24    |
From: johnturmel@gmail.com              JCT: Watching actions being filed, I noted a new hop-to-it:              On Aug 29 2019, Raphael Oswald Jr. LaTortue filed Statement       of Claim T-1443-19 for delay in Montreal.              On Sep 10, he filed a Motion for interim remedy.              On Sep 13, Judge Brown ordered:        "The Defendant is to file a response on or before        September 25 and the Plaintiff a reply on or before        October 4, 2019." placed on file on 13-SEP-2019              On Sep 25,        Letter from Defendant dated 25-SEP-2019 enclosing a copy        of the Notice of Abandonment on behalf of the Plaintiff        and informing the Court that the Defendant takes no        position on the motion -scanned to Justice Brown-        received on 25-SEP-2019              JCT: So they got his permit to him before the day they had       to file a response on the delay and not having contacted me,       he got talked into abandoning his claim for damages! That's       sad because my http://johnturmel.com/insdel.pdf page does       state:        If Health Canada issues your permit before the hearing,        they'll try to get you to sign to abandon your claim for        damages during the delay. Do not sign anything.              So they didn't have to file McGuire's affidavit explaining       the delay when they can say it's been abandoned.              So another happy "hop-to-it" kit user I might never have       noticed. Wonder if there are any more? With almost 400 files       to check, I won't know but it's nice to see another win       unexpectedly pop up.              --- SoupGate-Win32 v1.05        * Origin: you cannot sedate... all the things you hate (1:229/2)    |
