   JCT: Igor Mozajko's case was split off from Jeff Harris but   
   Judge Brown adopted the Harris decision for Igor too.   
      
   Harris appealed, Crown cross-appealed.   
   Crown appealed Mozajko, Igor cross-appealed.   
      
   Igor adopted Harris's original Memorandum of arguments. When   
   the Harris appeal was dismissed, Igor filed a Supplementary   
   Memorandum dealing with the points in the Harris decision   
   because the Crown was going to rely Harris to throw him out.

   DIRECTION   
      
   The respondent's Memorandum of Fact and Law was not served   
   and filed within the time prescribed by the Rules and should   
   not be filed by the Registry. As noted in the Court's order   
   of May 13 219, it is necessary for the respondent to bring a   
   proper motion for an extension of time.   
   The respondent's request to participate in the hearing by   
   way of teleconference or Skype shall be referred to the   
   Judicial Administrator.

   TAKE NOTICE that the Respondent will make a motion to the   
   court on the basis of written representations for an order   
   extending the time to file a supplementary memorandum and   
   dispensing with an affidavit for this motion.   
      
   THE GROUNDS FOR THE MOTION are that   
   1) with the Respondent relying on the memorandum of the   
   intervening appeal decision in Allan J. Harris v. HMQ A-258-   
   18, the Respondent should be able to present supplementary   
   arguments on issues that were not therein addressed.   
      
   AND FOR ANY ORDER abridging any time for service or amending   
   any error or omission as to form, color, font, margins,   
   content which the Honourable Justice may allow.

                     WRITTEN REPRESENTATIONS   
      
   1. I am also one of over 300 plaintiffs below for whom Allan   
   J. Harris was Lead Plaintiff until my action became   
   separated. Our issues raised in our appeals related to Claim   
   "A": "too long processing time" and Claim "B": "restitution   
   of the full term of the period of time."   
      
   3. Judge Brown dismissed the Crown motions to strike our "A"   
   claims but granted the motions to strike our "B" claims.   
      
   4. Allan J. Harris v. HMQ appealed against the "B" decision   
   and the Crown cross-appealed against the "A" decision A-258-   
   18. The Crown appealed against the Mozajko "A" decision and   
   I cross-appealed against the "B" decision relying on the   
   Harris memorandum.   
      
   5. Harris' appeal was dismissed and the Crown cross-appeal   
   was granted.   
      
   6. Respondent seeks an extension of time to serve and file a   
   supplementary memorandum on issues that were not addressed   
   in Harris, in particular, the failure of the Harris decision   
   to adjudicate Claim "B": "restitution of the full term of   
   the period of time" as not too trivial for Charter relief.

   JCT: So are the Court going to allow the Crown to use the   
   Harris decision and not allow Igor to file arguments
