|    TURMEL: Judge Sproat dismissed Dunseith     |

From: johnturmel@gmail.com              JCT: Brian Dunseith reports on his Quash Motion for his       medpot bust today.              BD: Dec. 20 at 5:37 p.m.              Hey John, Brian Dunseith and Linda M'Larkey here. In       Walkerton court today in front of Justice Sproat in Superior       Court. He dismissed the quash. He said something like,       whether he agrees or not, he will go along with other appeal       decisions.              JCT: So we put Justice Sproat on the POLCOA prong with the       choice to obey the Interpretation Act that says courts       cannot revive dead laws or the Ontario Court of Appeal and       other later decisions that they could. So he choise to       disobey Parliament in order to obey the higher courts.       Another name to the Wall of Shame judge who had to power to       repeal prohibition of cannabis and did not.              This could be one of the very last judges put onto the       POLCOA prong since the 2018 Cannabis Act revived the       prohibitions that had been killed in 2001 and not revived by       Hitzig in 2003.              BD: Back on Jan. 3rd to finish a focus hearing. Then a       discovery hearing on Jan. 21st.              JCT: The focus hearing is where he lets them know he's going       to be filing the Constitutional Motion 30 days before the       trial.              Not sure what the "discovery hearing" is unless it's a       preliminary inquiry. Regardless, they're going for judge and       jury with constitutional questions. Could be the very last       such challenge to strike the ACMPR! Though it won't help       with the Cannabis Act.              --- SoupGate-Win32 v1.05        * Origin: you cannot sedate... all the things you hate (1:229/2)    |
