John Clay has a grow       permit but his Guardian Medical Services has applied for a       micro-grow permit to grow for clinical trials and his       renewal included an amendment to move his personal location       to make room for his micro-business at the old location.              He had prepared a promotional video and posted it on his       site saying: these plants (his home garden) will be going to       clinical trials. He can't do any clinical trials until he       gets his permit when he'll have to take another picture       (same place, different crops) but that video got Health       Canada concerned he was providing his private pot to his as-       yet not-registered Guardian. Har har har. So here is his       Reply to McGuire's affidavit (haven't we kept him busy over       the years) in response to his motion for an interim permit       allowing him to move.              John Clay Turnbull              Monday Jan 13 2020              Senior Registry Officer       Courts Administration Service       Ottawa, Ontario, K1A 0H9              Dear Registrar              Re: TURNBULL, John Clay v. HMTQ File No: T-1222-18              I have received the Defendant's letter dated Jan 6 2020 in       response to the motion for interim remedy. Please place this       reply to that response before His Honour Judge Brown, Case       Management Judge.              Mr. Michael McGuire's Affidavit states:              a) On Oct 17 2018, Health Canada issued a Registration       Certificate to produce marijuana for medical purposes that       was to expire on Oct 17 2019.              b) On Aug 13 2019, my application was submitted to renew my       exemption and amend it by changing the location which was       not mentioned.              c) On Sep 24 2019, the application was returned as       incomplete.              d) On Oct 4 2019, I filed a completed application.              e) On Dec 31, Health Canada wrote requesting additional       information stating:        Guardian Medical Services appears to be operating an        unlicensed clinical trial, which we believe may be        supplied by the cannabis you are growing..              My application #8G0IMISRLS for my Guardian Medical Services       to be a micro-producer for clinical trials is pending.              Guardian cannot yet produce its own marijuana or deal with       it and so cannot have been supplied by my growing the       cannabis it did not yet need. Guardian has not yet conducted       any tests nor trials nor business of any kind other than       make preparations to do so. Mr. McGuire must know that the       Guardian application has not yet been approved and that no       illegal diversion was yet necessary for non-existent       clinical tests and trials.              This explains the application to amend the location of my       personal garden so my original facilities may be used by       Guardian. So everything is stalled until Health Canada       ascertains whether I was growing cannabis for Guardian that       it could not yet use.              Mr. McGuire says Health Canada will rule on the application       by Jan 16 2019, three days after the deadline for my Reply       to their Response. I would move that a decision on the       motion for interim remedy be deferred until then.              If my personal renewal and amendment are granted, the       interim remedy motion can be dismissed as mooted.              If not, I would ask to file a Supplementary Reply on why the       interim remedy should still be granted pending any further       hoops Health Canada can find to make me jump through.       ______________________________       John Clay Turnbull              CC FAX: Benjamin Wong 416-952-4518       Counsel for the Defendant              JCT: Why do you think Health Canada put off their decision       until after he had to file his Reply? How does it help       to keep it hanging? How does it hurt John?              So they made us deal with incomplete information until Jan       16.
