   Could you please place this update to the Dec 17 2019   
   Direction before the Case Management Judge Brown.   
      
   This is to inform the Court that on Jan 29 2020, Court of   
   Appeal Justice Marianne Rivoalen ruled in Docket: A-339-18:   
      
       THEREFORE THIS COURT ORDERS THAT:   
      
       1. The respondent's motion for an extension of time to   
       file his memorandum of fact and law is granted;   
      
       2. The respondent shall serve and file his memorandum of   
       fact and law, along with his memorandum of fact and law   
       as appellant by cross-appeal, as part of his memorandum   
       of fact and law, within 30 days of the date of this   
       order, in accordance with Rule 346(3)(a);   
      
       3. The appellant shall serve and file its memorandum of   
       fact and law as respondent to cross-appeal, within 30   
       days after service of the respondent's memorandum of   
       fact and law;   
      
       4. A fresh requisition for hearing shall be filed within   
       20 days after service of the memorandum of fact and law   
       of the appellant (respondent to cross-appeal);   
      
       5. Costs shall be in the cause.

   With the chance now afforded Mr. Mozajko to submit   
   supplementary arguments against the Harris appeal decision   
   that overturned your decision, I would submit it would be   
   premature to dismiss my action based on the Harris appeal   
   decision without awaiting the resolution of Mr. Mozajko's   
   appeals to sustain your decision.

   JCT: Since Steve is the only one who responded to Judge   
   Brown's direction, he's answering for everyone else. Now   
   that the Court of Appeal have let the appeal arguments   
   against the Harris decision in, how can he not wait to see   
   if his own decision is sustained.   
      
   And what may the Crown say in response to the Mozajko win to   
   convince him he should rely on the challenged Harris   
   decision and dismiss everyone's actions now. Har har har.   
   Bet not.
