      From: johnturmel@gmail.com              JCT: Back in early October 2018 before the Cannabis Act was       enacted, an exemptee was the second grower at the site of       another grower. They had an argument and the second guy cut       down the first's plants, put them at the side of the road       with the license permit and a video showing the plants being       tended, and called the police. Nasty!              He had an indoor-outdoor permit for around 150 plants but       the police picked up the evidence of 180 plants and two       years later, mailed him an indictment charging Production of       marijuana. Did they not notice the permit for the 150? They       want a fight over a 30-plant overgrow? Wonder if they were       clones? Remember, another Quebec Crown gave up on my       brother's 500-plant overgrow after 3 Provincial Court       motions, 3 Superior Court motions, 3 appeals and 1       application for leave to appeal to the Supreme Court? Before       plea.              If they had googled for Dominic's name, they'd have found       that on July 29 2004, he had been charged with one of the       biggest grow-ops in Quebec history, 6,000 plants! He was       denied bail. Then he filed my quash kit and after several       hearings, the Crown offered him a great get-out-of-jail deal       to quit fighting. He was quite the happy camper getting out       from pre-trial detention before Christmas and not facing a       life sentence trial. Imagine how that felt? From being stuck       in jail until the trial and then more, to getting out next       week for time served.              That was the only time I ever visited an inmate as his       counsel and not being searched. I'm not a lawyer!              His story starts Jan 23 2005       https://groups.google.com/forum/#!topic/alt.fan.john-turmel/OD6ofe-12GU              Just search his name for all his court adventures.              But being charged just before the Cannabis Act in late       October 2018 means he is not charged under a new valid       legislation with a new valid exemption regime, he is charged       under the old legislation while there was a bad ACMPR       exemption regime.              So he gets to use the present Quash motion that the law       remains dead since 2001 because only Parliament resurrects       dead laws, not the Hitzig Court. Law Professor Alan Young       telling TV how the Court of Appeal resurrected the dead       prohibition may have reassured the dupes into thinking that       the Courts had the power to raise up dead laws but I know       Parliament's Interpretation Act says only Parliament has       that power, even if MedPot hero shyster Alan Young told       Canadians the courts could revive dead laws too.              His first appearance was slated for April 7 but everything       in Quebec has been delayed.              So fun stuff coming up. Like Brian and Linda in Ontario,       Dominic has only the single S.7 production charge that gets       him a jury trial.
