   JCT: Igor Mozajko filed his Memorandum on Feb 27 and the   
   Crown had 30 days (to Mar 30 with weekends) to file their   
   Memorandum in response.   
      
   When the 30 days were up, we informed the Court right away   
   they'd missed their deadline. But they had an out.

        Re: Steve Vetricek v Her Majesty the Queen, T-1371-18   
      
   Please accept this letter as the response of the defendant,   
   Her Majesty the Queen in Right of Canada ("Canada"), to the   
   plaintiff's letter dated March 31, 2020. We ask that you   
   kindly place this letter before the case-management judge in   
   this matter, the Honourable Mr. Justice Brown.   
      
   The plaintiff suggests in his letter that Canada has missed   
   its deadline to file its appeal memorandum in HMQ v Mozajko,   
   Federal Court of Appeal File No. A-339-18. In fact, Canada   
   filed its memorandum of fact and law as appellant in the   
   Mozajko matter on February 4, 2019.   
      
   Canada's further memorandum as respondent to the Mozajko   
   cross-appeal was originally due on March 30, 2020. However,   
   the Federal Court of Appeal recently issued a Notice to   
   Parties and the Profession stating that the period March 16   
   to April 17, 2020, shall not be counted in the calculation   
   of time under the Federal Courts Rules or a court order, and   
   that the filing of documents during this time is not   
   encouraged. Canada will accordingly file its memorandum of   
   fact and law as respondent to the Mozajko cross-appeal after   
   April 17.   
      
   JCT: We didn't get the Notice to the Profession. At least   
   they know I ready to whack them the day after they make a   
   mistake.   
      
   C: The plaintiff's letter also reiterates his prior request   
   that his claim be stayed pending the Mozajko matter.   
   However, as detailed in our letter of February 20, 2020, the   
   plaintiff has identified no reason why his claim should be   
   stayed pending Mozajko. Canada accordingly reiterates its   
   request that the plaintiff's claim be dismissed for the   
   reasons given by the Federal Court of Appeal in Harris v   
   Canada, 2019 FCA 232.

   JCT: So they want it dismissed because of the reasons in   
   Harris being appealed by Mozajko before Igor's appeal is   
   heard. Bet not.
