|    TURMEL: Cops raid Doris New and leave wh    |

From: johnturmel@gmail.com              JCT: "Howard Popham & Doris New file 3,000-plant Quash       Motions" was my first article about 69-year-old Howard       Popham and his companion Doris New who had a farm on the       north shore of the Ottawa River and were busted for a crop       of over 3,000 outdoor plants in 2016. DNA testing was done       in 2017 and charges were in 2018. So they faced a Mandatory       Minimum of 2 years for both these oldsters when it's over       after many years.              McConnell & Popham serve motions on same Crown as Paquette!!       was the second article:              On Oct 30 Howard Popham's trial is coming up a hundred kms       away in in Campbell's Bay Quebec. Today, he served his       constitutional motion on Crown Marie-Claude Daoust in       Gatineau! She does both towns.       And don't forget that she just dealt with Luc Paquette's       constitutional motion before Judge Laflamme in Gatineau last       month.       So the three Quebec cases that make it to constitutional       voir dire at the opening of the trial are all with the same       Crown!! What a fluke.              "Howard Popham dies before medpot charges, widow goes to       trial" was the third article. Sad to report Howard passed       away. Guess he really qualified for medical need.       Doris will now have to face the production charge on her       own.              "Doris New medPot charges to be withdrawn after Howard       Popham's death" was the fourth article:              The Crown called to tell Doris that they would be       withdrawing her charges on June 19. So some good news.              So why is she in the news today? The Surete du Quebec just       had a massive raid on her farm. Lots of cops, vans to cart       off the illegal substance, a big operation.              But when she showed them her exemption paperwork for all of       it, they could only try counting her plants. Everyone kept       coming up with different numbers but close enough to her       limit that they gave up and left.              But as they were leaving, they noticed that one her       neighbors had 8 plants growing. He has cancer. So they       busted him.              I've advised that he get his exemption as soon as he can so       that he can make the argument that if he could establish       medical need just a few days after the bust, odds are he had       the same medical need at the time of the bust. And Paragraph       170 of the Hitzig decision said that "those who establish       medical need are simply exempt!"              But the persecution of the little guys goes on. A guy with       cancer busted for 8 lousy plants. I bet it won't make the       news.              Gisele Pilon is coming up this Friday in Gatineau court       again. She was busted while waiting for her permit. So her       doctor established her medical need before the bust and only       slow permit processing caused her to be charged.              --- SoupGate-Win32 v1.05        * Origin: you cannot sedate... all the things you hate (1:229/2)    |
