   Surely you are not suggesting that nothing is permitted unless required   
   by law?!?  That would make the vast majority of clauses in millions of   
   contracts invalid!   
      
   As far as I know a contract is valid so long as it does not violate any   
   applicable law so, unless there is a law FORBIDDING requiring tenants to   
   have insurance, it's perfectly legal, valid, and binding to include the   
   requirement in a lease.  As with most contracts, if it isn't against the   
   law then you can choose to sign it, you can negotiate it, or you can   
   walk away.
