6795e3f5       XPost: alt.fan.john-turmel, can.politics, alt.drugs       XPost: alt.conspiracy       From: johnturmel@yahoo.com              JCT: A few weeks ago, I got a call from Doug Brazier who had       been charged with S.7(1) cultivation and S5(2) Possession       for the Purpose of Trafficking but who had then received an       exemption. He filed his Quash Motion and Return of Pot       motion (within the required 60 days). He longer       Constitutional Stay motion could be added later if he had       to. He didn't have to.              Today, he received a letter from the Crown announcing that       they were withdrawing his charges, giving him back all his       equipment; but not his pot since he wasn't exempt when he       was busted. Arguing Hitzig 170, he's saying he proved       medical when busted by getting an exemption so why shouldn't       he get his medicine back like Derek Francisco did?              Of course, it's not up to the Crown to decide if he should       get his cannabis back, it's up to the judge who will be       seized of the motion the moment the Crown withdraws on Jan       8. What a nice way to start the day; with a non-loss I'll       soon be able to add to my http://johnturmel.com/wins.htm       page. Stay tuned for Jan 8.              --- SoupGate-Win32 v1.05        * Origin: you cannot sedate... all the things you hate (1:229/2)    |
