From: johnturmel@yahoo.com              TURMEL: MedPot Dynamic Duo Turmel-McIntyre in Fed Crt July 3              JCT: In last week's Applications by Ray Turmel and Henriette       McIntyre, Ray's was to take down the "glitch" at the web       site causing the bogus rejections and Henriette's was to get       a present-dated Authorization and to be processed under the       old regulations so she gets her full grow year.              Health Canada immediately satisfied Henriette's Part A       relief, a current-dated Authorization (but under the new       regs) and now she's going for part B, to be processed under       the old regs so she can get her whole grow year. Ray's was       put off as not that much of an emergency which could wait       for the General Sittings on Wednesdays.              So Notices of Return of Application were filed on the       Attorney General of Canada yesterday to be back before the       Federal Court at its General Sittings on Monday morning.              Henriette Marie McIntyre       Gatineau J8Y 6N8       Email: johnturmel@yahoo.com              June 28 2013              Pauline Chartrand,       Federal Court of Canada administrator       90 Sparks St. Ottawa              Dear Ms. Chartrand              I served and filed my application for the re-processing       of my Authorization to Possess and Produce medical       marijuana under the old regulations that I was due having       my Authorization completed and mailed out before the June       19 2013 publication of the new regulations in the       Canada Gazette. It's obvious if I was processed before       the new regime and received my permits before the new       regime, I should not have been processed under the new       regime.              So this Notice for Return of Application is being asked       for on only 2 clear days and not 3 clear days because the       Crown is prepared and will be caused no inconvenience. My       tort is for such elementary relief that it could be dealt       with summarily or even satisfied again before we get into       court.              Henriette Marie McIntyre              CC: Attorney General for Canada              File No:        FEDERAL COURT       BETWEEN:        Henriette Marie McIntyre        Applicant        and        Attorney General of Canada        Respondent               APPLICATION UNDER S.18 OF THE FEDERAL COURT ACT               NOTICE OF RETURN OF APPLICATION              TAKE NOTICE THAT on Wednesday July 3 2013 at 10am,       Henriette Marie McIntyre will make a motion to the Court       on short notice in person or as soon thereafter as the       motion can be heard at 90 Sparks St. Ottawa.              THE APPLICATION BEFORE THE APPLICATION FOR JUDICIAL       REVIEW WAS FILED FOR an Order granting Applicant interim       or summary relief:              1) a personal constitutional exemption to use marijuana       for medical purposes until the Applicant's Health Canada       exemption AP-HMM-09-M55571140-54-13-A which was mailed       June 18 but whose issuance was post-dated to June 28       2013, takes effect; a personal constitutional exemption       to my grower Nicole Van Edig to produce my marijuana for       medical purposes until the Applicant's Health Canada       Designated Grower's permit DPL-NV-09-M777471140-43-13-A       which was mailed June 18 but whose issuance was post-       dated to June 28 2013, takes effect.              2) an Order that Applicant's Authorizations to Possess       and to Produce be re-processed under the pre-June 19       regime they should have been processed under.              AND FOR ANY ORDER abridging the time for service or       amending any error or omission which this Honourable       Court may allow.              The Part A relief sought was satisfied before Justice Annis       when Health Canada immediately issued a new Authorization to       replace her post-dated one. The remaining issue was       adjourned without a date.              THE GROUNDS FOR THE APPLICATION ARE that if Applicant's       Authorization was mailed out on Jun 18 2013, its issuance       date should have been June 18 2013, not post-dated to June       28 2013 so she would fall under the new more onerous and       life-threatening regulations published in the Canada Gazette       on June 19 2013. Applicant's Authorization's Issuance date       properly processed under the old regime on June 18 2013       would make hers the last year-long authorization possible.              Though Health Canada acted immediately to correct her       glitch, it issued an authorization again processed under the       new regime that had not been in force when her authorization       had been due.       Dated at Ottawa on June 25 2013.       Henriette Marie McIntyre              JCT: And now Ray's Return of Application:              Raymond J. Turmel       6 Des Noisetiers       Grenville-sur-la-Rouge J0V 1B0 Quebec.       Tel: 819-242-9902 Fax: 519-753-5122 Cell: 819-328-6279       Email: johnturmel@yahoo.com              June 28 2013              Pauline Chartrand,       Federal Court of Canada administrator       90 Sparks St. Ottawa              Dear Ms. Chartrand              There are now almost 2,500 renewal applications received       in the past 4 weeks on the desks of Health Canada being       and about to be rejected due to the unmentioned Form F       glitch I was caught on that remains on the Health Canada       web site. It is to prevent those bogus rejections going       out right now that mandates the urgency of the motion.              The only way to stop them going out so they suffer the       same as I did is for the court to summarily strike down a       stupid yearly requirement as unnecessary, superfluous!       That stops all bogus rejections dead in their tracks and       solves the Crown's problems about people coming to       Federal Court to complain like I did at the same time.       The requirement for this rejection-causing form is so       stupid and detrimental to the health of the patients that       I hope to convince the judge to act summarily and on       short notice for the Return of the Application. Since the       Crown was aware since last week, I hope to convince the       judge there should be no problem with 2 days clear notice       rather than 3.              All grounds are the same with S.65, a completely superfluous       threat which is already contained in the Criminal Code whose       only purpose is to torment renewers.       Yours truly, Ray Turmel              File No:        FEDERAL COURT       BETWEEN:        Raymond J. Turmel        Applicant        and        Attorney General of Canada        Respondent               APPLICATION UNDER S.18 OF THE FEDERAL COURT ACT               NOTICE OF RETURN OF APPLICATION              TAKE NOTICE THAT on Wednesday July 3 2013 at 10am,       Raymond J. Turmel will make a motion to the Court on       short notice in person or as soon thereafter as the       motion can be heard at 90 Sparks St. Ottawa.              THE APPLICATION BEFORE THE APPLICATION FOR JUDICIAL       REVIEW WAS FILED FOR an Order granting Applicant interim       or summary relief:                     [continued in next message]              --- SoupGate-Win32 v1.05        * Origin: you cannot sedate... all the things you hate (1:229/2)    |
