   JCT: Can you believe that Ray Turmel's co-grower has just   
   had his Amended prescription post-dated too! His is the 4th   
   Federal Court Applications challenging MMAR malfunctions out   
   of one 3-license site! Now think of how the other 30,000   
   must have been treated.   
      
   Tony's doctor had sent in an increase in his prescription   
   and after 4 weeks, I decided that was long enough and wrote   
   him an Application for short notice hearing at the same time   
   as Ray's slated challenge to the Form F Glitch and S.65   
   Destroy Rule on July 17 2013 at the General Sittings of the   
   Federal Court of Canada.   
      
   It always starts with a letter to the Court Administrator   
   explaining the urgency behind the request for short notice.

   My doctor sent in my Marijuana Exemption Renewal with an   
   increased dosage from 8gm/day to 12gm/day.   
   After 4 weeks, in what the court has been told is an under-   
   3-week process, I still have no legal right to take my   
   increased prescription.   
   As the Health Canada telephone operators indicate, they have   
   8-10 weeks to process my amended exemption. I could have to   
   wait another 6 weeks before following my doctor's direction.   
   I'm asking the court on only 1 clear day's notice to allow   
   me to follow my doctor's direction immediately.

   TAKE NOTICE THAT on Wednesday July 17 2013, at 10am Tony   
   Van Edig will make a motion to the Court on short notice   
   or as soon thereafter as the motion can be heard at 90   
   Sparks St. Ottawa.   
      
   THE MOTION BEFORE THE APPLICATION FOR JUDICIAL REVIEW IS   
   FILED IS FOR an Order granting Applicant interim or   
   summary relief:   
      
   1) a personal constitutional exemption to allow Applicant   
   to follow his doctor's instruction to use 12gms/day of   
   marijuana for medical purposes rather than 8gms/day until   
   the Applicant's Health Canada Renewal of Authorization to   
   Possess MMAD-93761-12 arrives;   
      
   2) an Order declaring the non-instantaneous Marijuana   
   Medical Access Regulations ("MMAR") invalid.   
      
   AND FOR ANY ORDER abridging the time for service or   
   amending any error or omission which this Honourable   
   Court may allow.   
      
   THE GROUNDS FOR THE MOTION ARE that   
      
   1) Applicant's doctor never recommended that he wait to   
   start his increased prescription, and 4 weeks wait for a   
   Renewal that is supposed to average under 3 weeks to   
   process is an unconscionable delay violating the S.7   
   Charter Right to Life.   
      
   2) the non-instantaneity of delivery of medication by   
   requirement for a 8-10 week processing time in an era of   
   instant communications with most other government   
   departments is a violation of the S.7 Charter Right to   
   Life.   
      
   THE FOLLOWING DOCUMENTARY EVIDENCE will be used:

   I, Tony Van Edig, residing at 16 Des Noisetiers   
   Grenville-sur-la-Rouge J0V 1B0 Quebec make oath as   
   follows:   
      
   1. In 2012, I became a marijuana exemptee authorized to   
   consume 8gm/day.   
      
   2. On June 19, 2013, my doctor submitted my Renewal of   
   Authorization for an increased dosage of 12gm/day.   
      
   3. Almost 4 weeks later, I have not received my permit to   
   take my increased prescription.   
      
   4. If my doctor has no medical reason for me not to start   
   my increased prescription right away, what medical reason   
   could Health Canada have for me not starting right away?

              APPLICANT'S WRITTEN REPRESENTATIONS   
      
   1. Applicant's prescription was increased a month ago.   
      
   2. Director of Medical Cannabis Dr. Stephane Lessard   
   informed the Justice Roy in Ray Turmel v. HMTQ on May 31   
   2013 that new authorizations were being completed in under 4   
   weeks and renewals in far less.   
      
   3. Mike Spottiswood's first renewal was processed in 17   
   days.   
      
   4. Applicant has been waiting for 4 weeks to legally follow   
   his doctor's direction.   
      
   5. The 8-10 weeks allowed to process such an amendment must   
   be a violation of the patient's S.7 Charter Right to Life.   
      
   6. The non-instantaneous Marijuana Medical Access   
   Regulations ("MMAR") have to be a violation of the patient's   
   S.7 Charter Right to Life. No other medication would be   
   withheld so long in bureaucratic delays.

   Sittings list of July 17 for hearing on an urgent basis   
      
   Following the Applicant's Motion Record received by the   
   Registry on July 16 2013, the Court (Aronovitch, P.) on July   
   16 2013 directed as follows:   
      
   "The relief sought is not clear.   
   A complete motion record has not been presented for filing   
   and the urgency of the motion has not been demonstrated.   
   Do not accept the notice of motion for filing returnable at   
   General Sittings."   
      
   JCT: So because Prothonotary Aronovitch didn't think the   
   urgency of not being to take your medicine has been   
   demonstrated, no short notice hearing. I really expected   
   Alain to hop-to-it and get him his updated Authorization   
   like he did for Henriette to start his medicine right away   
   before I could strike again, wouldn't you have expected him   
   to avoid what I would do next? Har har har har har har.   
   Imagine, he got my first shot deflected by the court and   
   didn't batten down the hatches for the next?   
      
   After a week, I realized Alain had not managed to pressure   
   Health Canada to hurry up Tony's new prescription (you'll   
   find out why later) and prepared a full kit:   
   1) the Application for Judicial Review of their decision not   
   to issue his Authorization promptly and Affidavit;   
   2) the Notice of Motion on short notice or to be heard next   
   week at General Sittings so start his medicine right away.
