   TURMEL: Elisha McDermott doctor demands prompt medpot prescription   
      
   JCT: Exactly in the same boat as Tony Van Edig, Elisha   
   McDermott received her amended prescription post-dated to   
   Aug 16 when her old prescription expires!   
      
   So she filed her application for Judicial Review in Edmonton

   was is post-dated to Aug 16 2013.   
      
   I am in the exact same situation as Henriette McIntyre in   
   T-1118-13 who could look at her prescription but not take   
   it until the red tape ran out. Her Application was heard   
   on short notice and she only had to wait another 3 days.   
   I will have to wait another 18 days until Aug 16 2013 and   
   the urgency of my similar plight should the same   
   expeditious treatment as Henriette McIntyre did.

   This is an application for judicial review in respect of   
   Health Canada.   
      
   1. On June 10 2013, Applicant's doctor submitted the   
   Renewal of Authorization for an increased dosage of   
   marijuana for medical purposes.   
      
   2. When received, the Authorization was post-dated to Aug   
   16 2013 and processed under the pre-June 19 Regulations   
   that cut my grow term from Aug 16 to March 31, 20 weeks.   
      
   3. If Applicant's doctor has no medical reason for not   
   starting the increased dosage right away, what medical   
   reason could Health Canada to make Applicant wait?   
      
   3. The Applicant makes application for an Order declaring   
   that the non-instantaneity of the MMAR exemption process   
   in authorizing a doctor's prescription or amendment   
   thereto is a violation of the S.7 Charter Right to Life.   
      
   4. The Applicant seeks an Order to be processed under the   
   pre-June 19 2013 Regulations.   
      
   THE GROUNDS OF THE APPLICATION ARE:   
      
   5. Marijuana is the only Controlled Substance with a such   
   a lengthy approval period with a regular yearly renewal   
   process fraught with red tape delays. Health Canada adds   
   those who died before getting their medicine to its   
   "DORMANTS" file!   
      
   6. Given the instantaneous service by other government   
   departments through Service Canada kiosks, to not avail   
   itself of such instantaneous technology for medicine   
   delivery violates the Right to Life of all patients   
   forced to wait for their medicine, especially those who   
   end up dormant before the Authorizations to take their   
   prescription arrives.   
      
   7. This application will be supported by the following   
   material: Affidavit of Elisha McDermott. Expert Witness   
   Report of John Turmel, B. Eng.   
      
   8. The applicant requests Health Canada send a certified   
   copy of the following material that is not in the   
   possession of the applicant but is in the possession of   
   Health Canada to the applicant and to the Registry:   
      
   1) The average time it takes to process amendments to ATP   
   dosages?   
   2) the least time it has taken to process an amendment to   
   an ATP dosage?   
   3) The most time it has taken to process an amendment to   
   an ATP dosage?   
   4) The number of applicants who died while waiting for   
   the amendment to their ATP dosage to be processed?   
   5) The reason Applicant's authorization for an amended   
   prescription has taken more than 5 weeks to process?   
      
   6) The average time it takes to process an ATP?   
   7) the least time it has taken to process an ATP?   
   8) The most time it has taken to process an ATP?   
   9) The number of applicants who died while waiting to   
   have their ATP processed?   
   10) The reason Health Canada policy allows Authorizations   
   take 8-10 weeks to process?   
      
   11) Why forms may not be filed at Service Canada kiosks   
   and updated online like other government documents are?   
      
   12) What percentage of time is spent processing an   
   amendment and what percentage sitting on the pile?   
      
   13) Why post-date dosage changes to the end of the old   
   prescription?

    NOTICE OF MOTION   
      
   TAKE NOTICE THAT on Thursday July 29, 2013, Applicant   
   will make a motion to the Court on short notice by   
   telephone or as soon thereafter as the motion can be   
   heard.   
      
   THE MOTION IS FOR an Order granting Applicant interim   
   relief in a personal constitutional exemption to allow   
   Applicant to follow his doctor's latest prescription   
   for marijuana until the Applicant's Exemption takes   
   effect on Aug 16 2013.   
      
   THE GROUNDS FOR THE MOTION ARE that Applicant's doctor   
   never recommended waiting to start the increased   
   prescription and Health Canada lacks valid medical   
   reasons for denying Applicant the medicine until expiry   
   of the old prescription are a violation of the S.7   
   Charter Right to Life.   
      
   THE GROUNDS FOR THE MOTION ARE that   
      
   1) Applicant's doctor never recommended that waiting to   
   start the increased prescription, and being forced to   
   wait until Aug 16 is an unconscionable delay violating   
   the S.7 Charter Right to Life.

   I, Elisha McDermott, residing at 15965-106 Ave NW,   
   Edmonton, Alberta make oath as follows:   
      
   1.Ex.A is a copy of the ATP for my new prescription sent   
   July 25 but post-dated to Aug 27 2013, the date my old   
   prescription expired.   
      
   2. Ex.B is a copy of the my Personal Use Production   
   License ("PUPL") for 59 plants sent July 25 but post-   
   dated to Aug 27 2013.   
      
   3. On June 18 2013, in T-1118-13, Henriette McIntyre's   
   Authorization To Possess was issued but post-dated to   
   June 28 2013.   
      
   4. On June 25 2013, Health Canada issued an current-dated   
   Authorization To Possess dated June 25 2013.   
      
   5. This Affidavit is made in support of a motion for an   
   Order granting Applicant interim relief in a personal   
   constitutional exemption to allow Applicant to follow his
