      From: johnturmel@yahoo.com              JCT: After 5 years being exempted to use marihuana for       medical purposes, Health Canada tried to pull a sleaze and       refuse to renew Laurence Cherniak's Jan 26 2014 exemption       forcing him to close his self-medicate garden and destroy       all his stash!!!              I prepared him a Judicial Review of their Refusal and a       motion requesting an extension of his current exemption       pending adjudication of his Judicial Review that is going to       be heard Friday probably by telephone conference call.              File No: _________        FEDERAL COURT       BETWEEN:        Laurence Cherniak        Applicant        and        Attorney General of Canada        Respondent               APPLICATION UNDER S.18 OF THE FEDERAL COURT ACT               NOTICE OF APPLICATION              TO THE RESPONDENT:       A PROCEEDING HAS BEEN COMMENCED by the applicant. The relief       claimed by the applicant appears on the following page.                      APPLICATION              This is an application for judicial review in respect of       Health Canada.              1. On Nov 29, 2013 Health Canada informed Applicant of       the "intent to refuse" to renew the Personal-Use-       Production-License (PUPL) and Authorization To Possess       (ATP) marihuana for medical purposes pursuant to       S.12(1)(b) of the MMAR alleging at least one of the       requirements of ss.6(2) in the doctor's declaration       having to do with one of the three specialists cited in       my application not concurring that conventional       treatments were inappropriate was false or misleading.              2. No particulars were provided of which specialist had       disputed "at least one of the requirements in subsection       6(2).              3. No particulars were provided of which one or more of       the requirements were deemed false or misleading.              4. Applicant was given 30 days to produce evidence       rebutting the reasons for the refusal and reminded he       qualified under the new MMPR without a specialist though       he would have to shut down his self-production facility.              5. Having made the B-25 medical declaration in the same       way for the previous three renewals, having no idea what       evidence could be produced to rebut allegations without       particulars and having the utmost faith in his family       doctor's integrity, Applicant awaited the decision with       reasons for it.              6. Given the time it would take to dismantle a 5-year       investment, Applicant emailled Health Canada every day       for 10 days after the Dec 29 2013 30-days "more evidence"       period had passed seeking the decision and reasons.              7. On Jan 13 2014, Health Canada Marijuana Director       Stephane Lessard sent a letter of refusal which repeats       the allegations against the doctor's medical declaration       but provides no particulars; and is the subject of this       Judicial Review.              8. In R. v. Parker, the Court found that forcing a       medically-needy person to choose between prison and       health is unconstitutional. Should Applicant end up       accused, exactly the same arguments raised in Parker will       have to once again be raised by Applicant.              9. THE GROUNDS for the application are that the Refusal       was deficient in substance by allegations of impropriety       having no particulars that could be rebutted by my       physician who committed no malfeasance.              10. The applicant requests Health Canada send a certified       copy of the following material that is not in the       possession of the applicant but is in the possession of       Health Canada to the applicant and to the Registry:       Yearly number of Letters of Intent to Refuse sent.       Yearly number of Intents to Refuse reversed?       Yearly number of Refusals sent.              11.
