|    TURMEL: 5 Health Canada Federal Court Me    |
|    22 Feb 14 03:38:57    |
From: johnturmel@yahoo.com              JCT: I wrote a message to the Applicants in 5 Federal Court       actions that went on last year against the glitches in the       MMAR for Ray Turmel, Henriette McIntyre, Tony Van Edig and       Elisha McDermott.              Turmel: Time to take the win and wait for the next pot              For Ray's Feb 18 2014 hearing with Justice Shore:              RAY       T-997-13 Ray's application for renewal with Justice Roy       done.              T-1119-13       1) requirement for yearly Property Owner Consent superfluous       It's moot. They'll get away with the unmentioned Property       Owner's consent as a delay technique except for what we       write about what they did.              2) S.65 superfluous       Since there is a destruct order in the MMPR, we could keep       going on that fight.              T-1207-13 Application to store at new address       1) exemption to store supply at 6 Des Noisetiers,       Fixed so that's now moot though delay arguable.              2) resubmission of data in the not amended form superfluous       This is now moot.              3) yearly Property Owner Consent superfluous       Moot.              4) S.65 of the MMAR is a superfluous       Not quite moot but challenged elsewhere.              HENRIETTE       T-1118-13       1) a) exemption to use post-dated ATP and PUPL              2) Applicant's ATP and PUPL re-processed under pre-June 19       Almost moot and useless since they all expire now anyway.              TONY VAN EDIG       T-1271-13       1) to allow to new dosage right away       Moot.              2) declaring the non-instantaneous MMAR invalid.       Moot.              I got a letter from the Chief Justice asking for       representations about status revue. Looks like it would be       best if you could ask the Court to include Tony and       Henriette on Feb 18 because we may as well end it all.              T-1308-13       ELISHA MCDERMOTT 780-809-2236       Crown: Jaxine.Oltean@Justice.gc.ca 780-495-7324              1) use higher dosage away. same problem as Tony, so may as       well call it moot. We got it on record, a great story.              With the new MMPR you'll be challenging soon, you'll get       your licks in at the Destruct Order anyway.              So there's really nothing left to fight about. Short of us       making them hop around and look bad over and over, and make       the courts look bad for doing nothing over and over (it'll       make a great book to go with the kits though), we can't get       any more justice out of them than we got now.              Time to call it a win for the wins we won and call it a       stalemate. Only slim pickings left and we're going after       that in the next hand.              Have the call with Tony and ask him to include Henriette and       Elisha on the line in case the AG lawyer can accept the       draw.              Just tell Justice Shore that your legal advisor has advised       you all to "be happy with what you've all won and call off       the chase" of these particular nasty people. Lots more chase       coming up. You know you'll all be back later.              And your General Sittings day in Ottawa will be Wednesday       March 12, same as Halifax and Vancouver Exemptees are going       in. Others will have gone in Toronto and Montreal on Tuesday       March 11, so many that they won't dare not reserve the       decision and that means Wednesday's people all get heard and       will all have to be signed off on too. Elisha and others in       Alberta will have to book a sitting that week.              JCT: Then we got a Direction from Justice Shore that the       hearing was being put off until June:              Cossette, Marc       Feb 18 at 11:31 AM              Mr. Ray Turmel,              The following is a Memo to file entered by one of my       colleagues in the above-noted proceeding:              "As nothing has been received from Mr. Turmel in respect of       the provincial Court proceeding in Saint-Jerome, Quebec, the       matter does not appear to have been finalized therein as Mr.       Turmel has not sent anything to the Federal Court and       therefore the matter is not scheduled for any specific date       until such finalization of the provincial proceeding will       have been made known to the Federal Court with documents or       information of a concrete nature that would inform the Court       in the regards specified. If anything should be scheduled,       it should be scheduled for June with specific knowledge and       conclusion as to the provincial Court proceeding in Saint-       Jerome in that regard, otherwise the matter is in abeyance       until something is heard further or until the Court       determines that the file be closed due to inactivity."              He has indicated that unless letters are received from       counsel, the CMC will not be proceeding in these two files       on February 18, 2014.       ------------------------------              JCT: I'm not sure how the Quebec charge relates. I'd thought       it was the Crown to check with the St. Jerome Crown to       provide any such info, maybe misheard. Too bad, a chance was       missed to end it all.              So I wrote to Director General of the Justice Department       Civil branch Alan Prefontaine informing him:              To Marc Cossette FCC Registry, Alain Prefontaine       Feb 19 at 7:56 AM              Re:       RAY TURMEL: T-1119-13, T-1207-13       HENRIETTE MCINTYRE: T-1118-13       TONY VAN EDIG: T-1271-13       ELISHA MCDERMOTT: T-1308-13              Dear Mr. Prefontaine              It was unfortunate that the Feb 18 2014 hearing before       Justice Shore got put off to June because I had all the       Applicants ready to join in to end the quest for any further       relief that has been now been mooted by the end of the MMAR       era and close all the files.       Could you inform your staff that all the Applicants are       ready to call it off and deal with it accordingly?       ------------------------------              Prefontaine, Alain       To: John, Cossette, Marc, Binnie, Max, and Jaxine...       Feb 19 at 11:01 AM              As a courtesy, I am forwarding your email to the solicitors       of record for the respondent in the matters you list below,       for their information.       You are aware that I am not the solicitor of record in any       of those matters. Providing me with information related to       those application is thus not effective service and does not       relieve you from your obligation to comply with the       requirements of the Federal Courts Rules.       Alain Prefontaine       Director General and Senior General Counsel       ------------------------------              JCT: He doesn't like that I put the onus them to ready the       Discontinuance forms if they want to call it a stalemate and       wants me to do them. Then Max Binnie talks tough:              Binnie, Max       To Me,Oltean, Jaxine,Prefontaine, Alain, and 1 More...       Feb 19 at 11:11 AM              Mr. Turmel:       As previously discussed, you do not represent any of the       Applicants named below. As a result, you cannot discontinue       their applications. The Applicants should communicate their       desire to discontinue their applications directly to the       Federal Court in writing.       Once I'm notified of the discontinuance(s) I will seek       instructions from my client regarding whether they intend to       seek costs. Regards,       Max       ------------------------------                     [continued in next message]              --- SoupGate-Win32 v1.05        * Origin: you cannot sedate... all the things you hate (1:229/2)    |
