|    TURMEL: Her Majesty Defaults on Defence     |
|    16 Apr 14 23:44:54    |
From: johnturmel@yahoo.com              TURMEL: Her Majesty Defaults on Defence to Gold Star Claims              Jct: So Her Majesty is in Default of filing Her Statement of       Defence by Wed Apr 16 after I filed on Wed Feb 26!!! They       think they've snuck their motion onto the Big Event docket       getting their it filed "All-in-Sam's" file with a "courtesy       copy" to me and somehow duck the real threats to life we've       raised and only talk about their stay first.              So their default has given us another angle to get their       Motion struck from the docket, not only for being mis-       styled, but because a Defendant in Default can't file a       Motion! Har har har. Of course, they only put the improper       document into Sam's file and so Sam's next shot at the       Motion to be faxed in the morning:              Sam Mellace       Thursday April 17 2014              Federal Court Administrator, Fax: 416-973-2154       Re: T-485-14: T-855-14,T-861-14,T-896-14              Dear Sir/Lady:              Yesterday, I objected to the Style of Cause of the Attorney       General's Motion Record filed Mar 10 2014 which lumps me in       with a hundred other files without our being consolidated.       Looking at my Proceedings, they added even more names to my       file.              2014-04-15       "Letter from Defendant dated 15-APR-2014 asking that T-855-       14,T-861-14,T-896-14 be made subject to case management and       advising that Plaintiffs will be provided with courtesy       copies of its motion record concerning the stay of       proceedings filed on 10-APR-2014 received on 15-APR-2014"              The Crown has failed to file a Statement of Defence within       the required 30 days plus 15-day and 4-day stays by Crampton       C.J., that's 49 days, which expired yesterday April 16 2014       since I filed Feb 26 2014.              I therefore request that the Motion Record of the Defendant       in Default be struck from the file and from the docket for       the Apr 29 hearing for being both improperly-styled and for       being from a Defendant in Default.       Same Mellace       CC: Attorney General for Canada Fax: 613-954-1920              JCT: I'm adding to the pressure:              John C. Turmel, B.Eng.,              Wednesday April 17 2014              Letter to the Federal Court Administrator Fax: 416-973-2154              Dear Sir/Lady:              I objected to the Style of Cause of the Attorney General's       Motion Record filed Mar 10 2014 which lumps me in with a       hundred other files without our being consolidated.              As of yesterday Apr 16 2014, the Defendant Her Majesty The       Queen is in Default of filing their Statement of Defence       with the time prescribed in the Rules of the Court.              I object to having to respond to a Motion by a Defendant in       Default and want the Motion struck form the docket of the       upcoming Apr 29 2014 hearing of our motions for interim       relief.              I therefore request that the Motion Record of the Defendant       in Default be struck from the file it has been filed in and       from the docket for the Apr 29 hearing for being both       improperly-styled and for being from a Defendant in Default.              Of course, a properly-styled Motion may be filed up to Apr       22 2014.       John Turmel              Jct: That should take the wind out of their sails and make       them hussle to get everyone our personalized copies by Apr       22 like they should have all along. Ah, they haven't started       preparing yet? Gee, I told them a week ago. Should have been       ready for worst case scenario, what I usually put them into,       they should have known by now.              I can't relay my constant updates to all these groups. If       you want to follow current developments as they happen,       you'll have to watch my http://facebook.com/john.turmel for       status reports.              --- SoupGate-Win32 v1.05        * Origin: you cannot sedate... all the things you hate (1:229/2)    |
