      From: johnturmel@yahoo.com              Jct: Actually, Justice Phelan hasn't ruled yet but today's       order says it's game over for the Crown's stay motion.              DIRECTION       "Counsel for Canada is directed to advise the Court how it       was able to identify those Plaintiffs who fell within the       category of the Allard Plaintiffs and to advise whether it       is able to do so for subsequent matters likely to be filed."              JCT: It doesn't sound like "Crown Motion for Stay       dismissed," does it? But that's what it means!!!              Crown wants us all stayed until the far superior motion by       the far more experienced "fearless" QC lawyer with 40 years       experience gets heard first. If the Crown wins, there's no       reason to organize for hearing motions for exemptions any       more, right?              So when the judge today ordered the Crown to delineate the       Plaintiffs into their separate groups, do you think he's       making them do that in case he rejects their stay or because he's       going to reject their stay? Would he waste resources making       them do the work they'll have to do if the stay is rejected       in preparation for Part II if it won't be needed? or is he       just making sure they're ready to proceed with Part II when       we get back? Bingo.              I've been laying 10:1 on my Checkmate of their cinch, no       takers yet. So now, I bet he wouldn't order them to       prepare for handing out exemptions unless he was about to       be handing out the exemptions would he? Would he make them       waste all those resources then say, okay, now that we're all       ready for the Plaintiffs issues, we'll just skip it all?              Doesn't today's Direction to the Crown to delineate the       Plaintiffs into the Allard beneficiaries and non-Allard       beneficiaries indicate he's going to be dealing with them       differently, right?              If he's going to be dealing differently, then he's going to       be dealing with them, won't he? Which means he has to nix       the Crown stay to deal with them at all, right?              So when he ordered the Crown to get ready for the Part II       remedy, I think it's a pretty good indication that the Part       I stay is going to be refused.
