      From: johnturmel@yahoo.com              TURMEL: Ray Turmel "over-grow" medpot charge withdrawn              JCT: In Nov 2012 Ray Turmel was charged with over-growing       his 98 plant limit by 475 plants. The Surete du Quebec were       nice and let him keep his big plants and only took the       little ones, not like in Peterborough where they destroyed       the big ones and left Gerard Faux with his little ones.              Still, Ray was facing a statutory mandatory year in jail.              During that time, Ray filed 5 motions to Quash which were       repeatedly struck from the roll for wrong reasons. They       wanted to get on with a Preliminary Inquiry into the       evidence before Ray's challenge to the indictment would be       heard, putting the cart before the horse.              Ray then went to Superior Court, dismissed for wrong reason,       appealed. Ray then went to SCQ a second time, dismissed for       wrong reasons, appealed. Ray then went to SCQ a third time,       dismissed for wrong reasons, appealed.              Then there were 3 separate hearings at the Quebec Court of       Appeal resulting in dismissal.              Last week, Ray filed an application against 2 wrong-reason       precedents to the Supreme Court of Canada and a new motion       to quash including all the reasons why they couldn't stop       him quashing before the Prelim.              Today, Ray received a call from the Crown announcing that       they would be withdrawing the charge on Monday.              So Ray's being added to the http://johnturmel.com/wins list.              And the Appeal against the two precedents still goes no at       the top!!!
