|    TURMEL: David Shea dies while Action for    |

From: johnturmel@yahoo.com              JCT: Sadly, Nova Scotian David Shea, one of our Gold Stars       whose actions seeking an exemption to use marijuana was       stayed by Federal Court Justice Michael Phelan, has       succumbed to his cancer. I'm sure everyone is heart-broken.       David was nice kid.              I've written a Letter to the Court Administrator about it:              Sep 15 2014       Letter to the Federal Court Administrator              Dear Sir/Lady:              This is to inform you that David Shea whose Action T-972-14       for a marijuana medical exemption was stayed by Justice       Phelan has since died of his lung cancer.              Given this is only the first of the many terminal patients       whose relief was stayed to die, what can I tell his family       about his Action for damages by the prohibition that has now       impeded his survival. Is he still consolidated with the live       patients? Does the action continue for his estate? Is it       mooted?       John Turmel       CC: Attorney General for Canada              JCT: I wonder if he now has "sufficient evidence" of his       medical need to satisfy Justice Phelan.              Heidi says there's going to be a march on Friday Sep 19 in       Halifax down to the police station and to the Federal       Courthouse that gave David no remedy! I hope the Nova       Scotia team all bring their Gold Stars to wave around.              Some who had not filed their Motions for Interim Exemptions       to be dismissed for "insufficient evidence" of medical need       will be filing their new N13s (with motion for leave) before       it's too late for them too. Should be quite the show with       dozens who still haven't moved for it yet.              --- SoupGate-Win32 v1.05        * Origin: you cannot sedate... all the things you hate (1:229/2)    |
