   TURMEL: Crown loses move to dismiss "MedPot 26" Appeals   
      
   JCT: I wrote last about missing a deadline for filing some   
   documentation with respect to the 26 consolidated appeals of   
   Phelan J's refusal to grant interim exemptions to our   
   medically need while their action goes on and rather than be   
   magnanimous over my inadvertence, the Crown wrote a letter   
   trying to blow it out of proportion into a regular pattern   
   of disregard for deadlines hoping to dismiss the other 25   
   appeals on that technicality too. Not a chance.   
      
   Instead of just doing it wrong with a letter to the court,   
   they'd have to file 25 more motions to dismiss. And lose   
   because they're not going to be thrown out over an error by   
   a non-lawyer.   
      
   And I explained how my needing an extension of time for   
   inadvertence may have actually been a first, not a pattern!   
   They hadn't really thought about the ramifications which I   
   explained in my Reply. The decision of Justice Ryer:

   WHEREAS the Appellant John  C. Turmel is lead Appellant in   
   A-342-14 which has been consolidated with 25 other appeals;   
      
   WHEREAS by Order dated December 12 2014, Boivin J.A.   
   stipulated that the agreement as to content of the   
   consolidated Appeal Book was required to be filed on or   
   before January 24 2015;   
      
   WHEREAS the Appellant has, though his admitted inadvertence,   
   failed to file such agreement within the time in the Order   
   of Boivin J.A.;   
      
   WHEREAS the Appellant has brought this motion for an order   
   to extend the time for filing such agreement to Rule 8;   
      
   WHEREAS the Respondent, by letter dated March 17 2015, but   
   not by filing a motion record in accordance with Rule 365,   
   opposes this motion.   
      
   AND WHEREAS the interests of justice favour - but just   
   barely - the granting of the motion, in spite of the   
   Appellant's seeming indifference towards compliance with the   
   Order of Boivin J.A.;   
      
   THIS COURT ORDERS that:   
      
   1. The motion is granted and the time for filing the   
   agreement as to contents of the consolidated Appeal Book be   
   and is hereby extended to April 10 2015.   
      
   2. If such agreement is not filed before April 11 2015, then   
   this consolidated appeal may be dismissed for delay.   
      
   3. The Respondent shall be entitled to costs of $100 with   
   respect to this motion, which costs shall be payable,   
   personally, by the lead Appellant, Mr. John C. Turmel.

   365, opposes this motion."   
      
   At least he slapped the Crown for not following the rules.   
   Bet they don't do that again.   
      
   The Crown wanted $200 in their costs (for 1 letter) for all   
   26 Appellants, $5,200. If they'd filed 26 motions to   
   dismiss, maybe, but to cover the expenses of their improper   
   letter, I'd have to say the $100 cost was about as token a   
   slap as I could have gotten for causing the delay.   
      
   Back on track.
