   I think you also want to check for 'Locked' and 'New', as in:

   and  active.RecordStatus("New"))   
   or  (eventInfo.id() = DataUnlockRecord   
   and (active.RecordStatus("Modified")   
   or   active.RecordStatus("Locked"))) then	   
   	ModDate.value = today()
