   A lot of the licensing agreements say* something along the lines of "by   
   opening the packaging you agree...", which of course is inside the   
   shrink-wrap.   
      
   Similarly, once you've opened the packaging, you'll have a much harder   
   time trying to return it to the store for a refund if you've simply   
   changed your mind about buying it.   
      
      
   * At least they used to. These days with everything being streaming and   
   downloadable, there is less and less that actually come in packaging.
