   MS could exert some influence.  It wouldn't take much and it wouldn't   
   cost them anything.  Basically this goes into contract law.  If one   
   party makes a contract using obtuse of unclear language or wording with   
   the intent of tricking people, the contract is void.   
   MS could start complaining and telling those companies to stop using   
   their OS as a medium for trickery.
