I think it goes beyond privacy.  Like the EFF stated, "Even  
searches that refer to crimes or acts of terror are not  
themselves criminal in all or even most cases (otherwise  
historians, reporters, and crime novelists could all be subject  
to criminal investigation). "

And, once the freedom for agencies to track and indentify  
persons of those searches becomes common place, there will be  
little any citizen could do except either NOT use searches, or  
live behind a VPN for all internet activity.

Myself, I am not fond of doling out more money for internet  
use.

There can still be a chance to challenge a judge's decision.  
Judge's are known to make errors.
