      XPost: alt.crime, alt.niggers, alt.politics.guns       XPost: sac.general       From: Davecross@kremlin.ru              It’s better to be lucky than good.              A Bronx man arrested twice for gun possession and potentially       facing years behind bars escaped the long arm of the law twice,       the Daily News has learned.              Ebrima Faal’s arresting officers in one bust was shot to death       two months later in a tragic case of friendly fire. And the cop       who claimed to catch him with a gun in the other case went on to       be arrested for child porn.              When both cases were tossed out last week because of the fates       of his arresting officers, Faal, 21, celebrated on Facebook,       writing “JUST BEAT 2 GUN CASES” above an emoji of a flexing       bicep. His jubilant message soon garnered over 130 likes from       pals and more than 50 comments of praise like “As u should my       guy.”              But when the Daily News caught up with 21-year-old Faal he was       less effusive.              "I’m just a victim,” he said Tuesday. “I’m sorry. I’m not happy       about what happened.”              “I can’t talk about the cases,” he added. “Of course, I’m not       guilty.”              NYPD sources insist Faal was carrying guns in both incidents and       that he’s fortunate to be free.              On July 17, Faal was busted for possession of a .25-caliber       handgun at Crotona Ave. and Garden St., just up the block from       where he lives with his parents, police sources said.              The arresting officer, Brian Mulkeen, was killed Sept. 29 during       a tragic case of friendly fire while trying to arrest Antonio       Williams, an armed ex-con who bolted when cops tried to question       him about gang activity.              Police said Williams reached for his own gun but Mulkeen fired       his weapon five times before the ex-con could get off a shot.       The officers behind Mulkeen started shooting as well, striking       Mulkeen twice and killing him. Williams also died in the blaze       of bullets.              NYPD officer killed in 'violent struggle' with gunman       Before Mulkeen’s death, Faal’s gun was taken into evidence by       police and Mulkeen had articulated the details of the incident,       police sources said. But the Bronx District Attorney’s office       felt it couldn’t win a conviction without Mulkeen alive to       testify, the sources said.              Faal appeared in Bronx Criminal Court last Wednesday and the       case was dismissed, prompting his jubilant Facebook post that       morning.              Faal’s other case was also dismissed that morning, but for an       entirely different reason.              In August, NYPD Officer John Telesca was busted off-duty for       kiddie porn at his home in Westchester. He allegedly had at       least 60 pictures of naked children between ages 8 and 13 on his       electronic devices.              Telesca also allegedly shared the disturbing photos by email. He       was charged with possessing and promoting an obscene sexual       performance by a child and released on $5,000 bail. The NYPD       suspended him without pay after his arrest.              Following Telesca’s arrest, Bronx prosecutors began taking a       look at his arrest record as a NYPD officer, police sources said.              On Feb. 1, 2018, he busted Faal at Webster Ave. and Fordham Road       for allegedly carrying a .40-caliber handgun, police said.              That case appeared to be nearing trial when Telesca was busted.       The DA’s office decided it couldn’t successfully prosecute       Faal’s case because of the legal troubles Telesca was facing,       sources said.              The Legal Aid Society, which represented Faal in the Mulkeen       case, had no comment Tuesday. Legal Aid also represented Faal in       the other case right after the arrest, but another lawyer took       over after that. It wasn’t clear who that lawyer was.              Patrice O’Shaughnessy, a spokeswoman for the Bronx DA’s office,       confirmed both gun cases were sealed and dismissed. She had no       comment on the Telesca case but said that the Mulkeen case was       dismissed because “we would not have been able to prove the case       beyond a reasonable doubt.”              Faal also has three marijuana and a fare evasion arrest on his       record, police sources said.
