   It is, but trademarks are specific to lines of business.  It is   
   entirely possible and not at all unusual to have similar trademarks   
   for unrelated businesses.  Look, for example, at all of the stuff that   
   uses the name "Red Cross" ranging from blood banks to pickles.   
      
   As other people have pointed out, toll highways and pizza are utterly   
   unrelated businesses, and this suit is a waste of toll money.
