   But see the 2004 Supreme Court case _DOT v. Public Citizen_.   
   Environmental review is triggered by a combination of major   
   federal action and discretion on the part of the agency.   
   The DOT was not required to consider pollution by Mexican   
   trucks when making operating rules.   
      
   There was a vaguely similar case on the state level in   
   Connecticut a year or two ago.  The State Traffic Commission   
   was not required to consider environmental impact when   
   granting a curb cut.
