Sigh

Did you know that railroads and pipelines and other utility companies
have the power of condemnation in state law? They need rights of way
in relative straight lines and, when curving, generous curves. They
usually but not always negotiate for the property they need.

Nevertheless, they have this power in state law.

Utilities are never 100% private enterprise and they are not perfectly
competitive.
