They do meet the recently updated FRA Tier I standard. Similar DMUs are
going to be deployed in California (Sonoma-Marin SMART Service). For
that service they meet the following requirement spelled out in the RFP:

"The vehicles shall be designed and manufactured to be in compliance
with 49 CFR 238 requirements applicable to Tier I Passenger Equipment
and with all applicable APTA and AAR standards and recommended practices."
