      From: atropos@mac.com              So we have another rogue judge on our hands that has ordered Trump to extend       the temporary protected status for Haitian refugees that was put in place by       Biden. Trump wasn’t even canceling it. It was just set to run out on its own       based on the terms Biden put in place, but a judge not only said the president       has no authority to let it run out, he ordered Trump to affirmatively renew       it. So this judge implicitly acknowledges that renewing/canceling/extending       this program is an inherent power of the presidency but that he— an unelected       judge— gets to determine if, how, and under what conditions the president can       exercise that power, even to the point of telling the president he can’t       *not*       exercise that power if the judge decides otherwise.              This is simply not something that an Article III court has jurisdiction over.       The judge is literally positioning himself as some kind of "super-president"       who gets to decide public policy/foreign policy and overrule the actual       elected president if that public policy isn't to his liking.              --- SoupGate-Win32 v1.05        * Origin: you cannot sedate... all the things you hate (1:229/2)    |
