A prenup is not binding unless and until the marriage takes place.
   No marriage, useless prenup.
And it can be revoked before marriage.

A diversion agreement is not binding unless and until the plea deal is
   adjudicated.
No pleas deal, useless diversion agreement.
And it can be revoked by the judge as part of processing the plea deal.
If the judge refuses to process the plea deal, the diversion is moot and
   invalid.
