   in many places, if it's not attached to the vehicle (i.e., not in a   
   mount on the dashboard), you are in violation.   
      
   you don't actually have to be doing anything with it and could even be   
   removing it to put in your pocket.   
      
   the car doesn't need to be in motion either. you could be stopped at a   
   traffic light and be cited.
