   The correlation for accidents is completely irrelevant, as is whether   
   or not that law itself is sensible in any individual's opinion.   
      
   There is no grey area - the law states that you are not allowed to use   
   the cellphone while driving, and he did use it while "driving" (even if   
   technically stopped in a traffic jam). He did not pull over and use it   
   legally while not driving. Therefore he did break the meaning of that   
   law (if not the actual restrictive wording of it) and deserved the   
   ticket he got.   
      
   The problem is simply that the wording hasn't kept up with the times,   
   as with many laws for the fast-changing technology world.   
      
   If it's iilegal to read a book while driving, then how is it sensible   
   to believe you can read a phone while driving??
