   It's not an FAA issue. Any such individual is going to be crossing   
   the State Department and the Defense Department. There are many, many   
   laws about tech transfer of military grade equipment and you simply   
   can not build an orbital vehicle without transferring tech with   
   military implications.   
      
   If it is a friendly country, they start with polite requests from the   
   State Department. But, usually quickly followed by extradiction   
   requests. Also, they can put that company under a prescribed list   
   which would be banned from any US based contracts.   
      
   There are hundreds, of not, thousands of ways to make this very, very   
   unpleasant. It is unlikely that someone like Tonga, or Venezuela   
   would even remotely consider protecting a company that has ticked   
   off the US State Department.
